ORDINANCE No. 950 <br />Mr. Busa <br />AN ORDINANCE ACCEPTING TRE BID OF CIIARLES E. SHIFFER, <br />JR, FOR GARBAGE AND RUBBISH_ PICIC-UP t1ND DISPOSAL <br />QN CERTAIN CONDITIONS __ <br />WHEREAS, the Clerk-Treasurer has advertised for bids according to law <br />for garbage and rubbish pick-up and disposal; and <br />WHEREAS, quigley Disposal, Inc, filed a bid, which was invalid because <br />it was not accompanied by the required bid check, and Charles E. Shiffer, Jr., <br />Geauga Disposal Company and Cra*aFord Disposal Company filed bids speci£ying a <br />monthly.fee of $695.00, $727.50, and $840,00 respectively; and <br />WkiEREAS, Council is in some doubt as to whether said Charles E. Shiffer, <br />Jr., the lowest of said bidders, is able to furnish the necessary equipment to <br />perform the contract. <br />NOFI THEREFORE BE IT ORDAINED BY THE COUNCIL OF THE VILI.AGE OF MAYFIELD, <br />CUYAHOGA COUNTY, OHIO, THAT:. .. _ . . - - • <br />Sec. 1. The Mayor and the Clerk-Treasurer are hereby authorized to enter <br />into an Agreement on behalf o£ the Village of Mayfield with said Charles E. <br />Shiffer, Jr., incorporating the terms of his bid and the specificatiotts upon <br />which he bid, which, among other things, provides for collection and disposal <br />of garbage and rubbish from the residences in the Village of Mayfield once a <br />week for the sum of $695.00 a mottth, such pick-ups to be made on Friday, except <br />in case of holidays,.when it shall be made on Saturday. Said contract shall <br />provide that the Village reserves the right to cancel the contract upon giving notice <br />30 days by certified mail for breach of any terms or conditions of the contract, <br />the bidder reserving the same right. Said contract shall further provide for an <br />increase of compensatiott for any additional 25 homes added to the present 749 <br />homes, at the same rate provided in the contract. <br />Sec. 2. Said contract shall not be entered into with Charles E. Shiffer, <br />Jr. unless by APril 1, 1966, Crawford Disposal Company shall guarantee in <br />i,Triting that it will furnish to said Shiffer the necessary equipment to carry <br />out the said contract in the event that said Shiffer does not have sufficient <br />equipment. Said contract is further conditioned upon the furnishing by April <br />1, 1966, of a Performance Bond signed by a responsible insurance or bonding <br />company in the_amount of $8340.00. <br />Sec. 3. In the event that said Charles E. Shiffer, Jr. shall fail to <br />furnish said guarantee of equipment and said Perfiormance Bond by April 1, 1966, <br />Couttcil reseives the right either to award the contract to the Geauga Disposal <br />Company as the second lowest bidder, or to reject any and all bids. .
