the Work and constructing the System, OneCommunity will provide the Village thirty (30) calendar days' prior notice of any such relocation, if possible, and will proceed with such relocation upon consent of the Village, which shall not be unreasonably withheld. 3.6.2 If OneCommunity determines that a relocation is necessary to maintain network connections and preserve the System's connectivity, OneCommunity may relocate the affected portion(s) of the System without consent of the Village. Upon completion of such relocation, OneCommunity and the Village shall mutually determine whether a subsequent relocation is necessary to preserve the System's connectivity on a long-term basis. The Village shall reimburse OneCommunity for the Costs incurred by OneCommunity for any relocation performed to maintain network connections and preserve the System's connectivity. 3.6.3 OneCommunity will have the right to direct any relocation, including the right to determine the extent oi; the timing of, and methods to be used for such relocation, provided that any such relocation will: standards; 3.6.3.1 be constructed and tested in accordance with then current industry 3.6.3.2 not result in a materially adverse change to the operations, performance, Connecting Points with the Village's network, or end points of the Major Segment; and 3.6.3.3 not unreasonably interrupt service on the System. 3.7 Maintenance of Equipment Excluded. OneCommunity will have no obligation under this Agreement to maintain, repair, or replace optronic (opto-electrical), electronic, or optical equipment or materials, facilities or other equipment owned, possessed or utilized, by the Village, unless OneCommunity provided the optronic (opto-electrical), electronic, or optical equipment or materials, facilities or other equipment to the Village. Maintenance of such equipment will be pursuant to separate service agreements. 3.8 Contacts. The Village will identify one or more persons to be the primary contact(s) with whom OneCommunity personnel will interact in regard to the ongoing operations of the System. Section 4. Construction. 4.1 Fiber Construction. OneCommunity will use Corning SMF-28e fiber in the construction of the System. 4.2 Pre-Construction IDocumentation. OneCommunity will supply apre-construction documentation package prior to beginning construction, which will conform to the Specifications and include: construction specifications, scope of work, manufacturer cut sheets for all equipment, and materials used during construction. The Village acknowledges that the details presented in the pre-construction documentation package may need to be modified as the Work progresses. 6 As of 01/29/2009
