4.3 As-Built Documentation. OneCommunity will supply copies of all written permit <br />applications filed with any municipality, updated scope of cabling and structure as installed, <br />drawing sheet identifying finished depths of construction, details of pathway, tie-ins to existing <br />conduit structures, signed copies of as-built documentation, digital copies of as-built <br />documentation, drawing detail sheets and manhole details. <br />4.4 Fiber Acceptance Testing. Exhibit 7 attached hereto sets forth Fiber Acceptance <br />Testing procedures, procedures for determining the Acceptance Date, and test deliverables that <br />OneCommunity will provide to the Village. Upon installation, OneCommunity will ensure bi- <br />directional OTDR testing is performed on the Fibers. <br />4.5 Acceptance Date Obligations. As of the Acceptance Date: <br />4.5.1 OneCommunity will have obtained all rights, licenses, authorizations, easements, <br />leases, fee interests, or agreements that provide for the occupancy by the Major Segments of real <br />property or fixtures (such as conduit, bridges, river crossings, or transmission towers); <br />4.5.2 OneCommunity will, by IRU agreement, lease, or otherwise, have obtained any <br />and all rights necessary to complete the Work and construct the System; and <br />4.5.3 each Major Segment will be designed, engineered, installed, and constructed in <br />accordance with the Specifications. Any deviation will not materially diminish the performance, <br />reliability, or expected useful life of the Fibers in such Segment. <br />4.6 The rights OneCommunity is required to obtain pursuant to subsections 4.5.1 and 4.5.2 <br />above will be referred to as "Required Rights." OneCommunity will renew or replace existing <br />Required Rights through the Term. As of the Effective Date, no Required Rights have been <br />necessary to facilitate the terms and conditions of the Agreement. <br />4.7 Acceptance of the System. Upon completion of the Work, OneCommunity will submit <br />a Certificate of Final Acceptance to the Village, which shall be signed by an authorized <br />representative of the Village and returned to OneCommunity no later than fifteen (15) days from <br />receipt. Upon receipt of the executed Certificate of Final Acceptance, OneCommunity will <br />immediately provide the Village with System connectivity. <br />Section 5. Connections/Access to the System. <br />5.1 Connections. Unless otherwise agreed by the Parties, the Construction Charges will <br />include one lateral connection to be installed by OneCommunity at the Village fire station <br />located at 770 S.O.M. Center Road. The Village will pay OneCommunity for Costs incurred as a <br />result of installing any additional lateral connections and will at its own cost obtain any and all <br />rights from third parties required to make such connections or compensate OneCommunity for <br />obtaining those rights. OneCommunity's Costs for any requested connection will be calculated <br />and the Village will pay OneCommunity the full amount of such calculation prior to the work <br />being performed by OneCommunity. Any additional connections to the System will be subject <br />to separate agreements. <br />7 As of 01/29/2009 <br />
