lifeguards to staff the pool during the Labor Day weekend, any and all HAYFIELD <br />VILLAGE and HAYFIELD HEIGHTS resident pool pass holders shall be provided <br />admission to the HIGHLAND HEIGHTS municipal pool as follows: <br />• Resident season pass holders: free of charge <br />• Resident non-season pass holders: $5.00 per resident <br />per day during the Labor Day weekend, for outdoor <br />pools only. <br />IV. CHARGES. <br />More fully, no charge shall be made to or by any Party for the services rendered under <br />this Agreement except as hereinto provided; it being the expressed intention of the Parties that <br />the sole consideration is the mutual promises, each to the other, of rendering services as agreed. <br />V. DAMAGES-LOSSES-INJURIES. <br />The Parties agree that no Party rendering services under the provisions of this Agreement <br />shall seek damages or reimbursement for loss or damage to equipment from any Parry hereto <br />requesting such services, except as hereinafter provided. Further, there shall be no <br />reimbursement for any indemnity award or premium contribution assessed against the Providing <br />Party for Workers' Compensation or other benefits arising by reason of injury or death to a <br />member of a force of such Party in providing services under the terms of this Agreement. It is <br />mutually agreed between the Parties hereto that the Requesting Party shall be solely responsible <br />for any loss or damage sustained by third Parties injured or damaged by any act of said Providing <br />Party in rendering services. <br />VI. TERM OF AGREEMENT. <br />This Agreement shall be in effect for a period of one (1) year from the effective date of <br />this Agreement and shall be automatically renewed for successive periods of one (1) year as to <br />all Parties, unless termination and notice to withdraw is completed in accordance with the terms <br />of Article VII. <br />VII. TERMINATION (NOTICE). <br />A Party may terminate this Agreement at the expiration of any term or at the end of any <br />successive automatic extension term, by serving written notice by certified mail on the Party <br />designated below, no later than thirty (30) days prior to the expiration of the term. <br />Page 3 of 6 <br />
