MUTUAL EXCHANGE OF SERVICES AGREEMENT <br />This Agreement is entered into this ~ ~'~ y of ; ` -~~' `-~-~, 2014, by and between <br />HAYFIELD VILLAGE, OHIO, an Ohio municipal ~ corporation, HIGHLAND HEIGHTS, <br />OHIO, an Ohio municipal corporation and HAYFIELD HEIGHTS, OHIO, an Ohio Municipal <br />corporation, (hereinafter a "Municipality" or collectively, "Municipalities"). <br />WHEREAS, it is the expressed desire of HAYFIELD VILLAGE, HIGHLAND <br />HEIGHTS and HAYFIELD HEIGHTS to enter into a mutual exchange of services <br />agreement for the interchange of reciprocal emergency management assistance or aid in <br />the form of lifeguard services between and among their municipalities, as deemed <br />necessary, on an as needed basis; and situations contemplated under Ohio Revised Code <br />§ 5502.29 including, but not limited to, a Planned Event as defined by O.R.C § <br />5502.41(A)(5); <br />WHEREAS, this mutual exchange of services agreement will provide HAYFIELD <br />VILLAGE, HIGHLAND HEIGHTS and HAYFIELD HEIGHTS the access to each <br />other's lifeguard staff, for Planned Events and as deemed necessary, on an as needed <br />basis, and as agreed between the municipalities, as the need may arise within the <br />respective individual jurisdictions wherein current staffing is deemed inadequate; and <br />WHEREAS, this mutual exchange of services agreement will allow for the provision of <br />reciprocal services across jurisdictional lines, enhance the capabilities of each community <br />to provide lifeguard staff to meet staffing requirements and extend recreational pool <br />access through Labor Day weekend for at least one (1) of the three (3) municipal pools. <br />THEREFORE, this Agreement is entered into upon the following terms and conditions, <br />by and between the Municipalities hereto, with the mutual promises of each to the other as <br />consideration therefore: <br />I. PRIMARY RESPONSIBILITY. <br />No provision of this Agreement shall be construed as to place liability upon any other <br />Municipality hereto for failure to fulfill a request for services. <br />
