<br /> <br />~s.e, ~ <br />ORDINANCE NO. 2004-06 <br />INTRODUCED BY: Mayor Rinker and Council as a Whole <br />AN EMERGENCY ORDINANCE <br />AMENDING THE CODIFIED ORDINANCES OF HAYFIELD VILLAGE REGARDING <br />THE POSSESSION OF CERTAIN WEAPONS IN PUBLIC PLACES <br />WHEREAS, upon recommendation of the Chief of Police, Mayor and Council <br />deems it in the best interest of the health, safety and welfare of all Village residents to <br />amend Chapter 549 of the Codified Ordinances so as to make it illegal to possess <br />certain weapons in public places. <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF HAYFIELD <br />VILLAGE, OHIO, THAT: <br />SECTION 1. Chapter 549 of the Codified Ordinances of Mayfield Village is <br />amended by adding new Section 549.11 as follows: <br />549.11 Possessing Certain Weapons in Public Places <br />(a) No person shall knowingly carry, have in his or her possession or <br />ready at hand any firearm, handgun, dangerous ordnance, shotgun, rifle, karate <br />sticks, brass knuckles, blackjacks, billyclubs, switchblade knives or knives having <br />a blade over two and one-half (2 '/2) inches in length, or any device or instrument <br />manufactured, fashioned or designed as a deadly weapon, while at or about a <br />public place. <br />(a) As used in this section "public place" means any place to which <br />the general public has access and a right to resort for business, entertainment or <br />other lawful purpose, but does not necessarily mean a place devoted solely to <br />the uses of the public. It also includes the front or immediate area or any store, <br />shop, restaurant, tavern or other place of business and any grounds, areas or <br />parks where persons would congregate. <br />(a) A weapon described in subsection (a) hereof, found in the <br />possession or ready at hand of any person in a public place in violation of this <br />section, may be seized by the police and may be returned or disposed of by the <br />Chief of Police in accordance with the ordinances of the Village of Mayfield and <br />the laws of the State of Ohio. <br />
