,._, <br />.~ <br />Ordinance No. 2004-06 <br />Page 2 <br />(a) This section does not apply to officers, agents or <br />employees of this or any other state or the United States, or to law <br />enforcement officers or certified private security personnel authorized to <br />carry weapons or dangerous ordnance and acting within the scope of <br />their duties. <br />(a) This section shall not apply if any weapon in subsection , <br />(a) hereof was part of a public weapon display, show or exhibition, or <br />was in possession of a person participating in an organized match, <br />competition or practice session. <br />I. Any affirmative defense available under Section <br />549.02(c) shall constitute an affirmative defense to a charge under this <br />section, provided that the actor is not otherwise prohibited by law from . <br />having such weapon.. <br />Whoever violates this section is guilty of possessing <br />certain weapons at or about public places, a misdemeanor of the first <br />degree. <br />SECTION 2. All other Codified Ordinances of Mayfield Village shall <br />remain as presently drafted unless inconsistent with this ordinance. <br />SECTION 3. The Council finds and determines that all formal actions of <br />this Council relating to the adoption of this Ordinance have been taken at open <br />meetings of this Council; and that deliberations of this Council and of its <br />committees, resulting in such formal action, took place in meetings open to the <br />public, in compliance with all statutory requirements including the requirements of <br />Section 121.22 of the Ohio Revised Code. <br />SECTION 4. This Ordinance is hereby declared to be an emergency <br />measure immediately necessary for the health, safety and welfare of the <br />residents of Mayfield Village, Ohio. It shall, therefore, take effect immediately <br />upon the passage by the affirmative vote of not less than five (5) members <br />elected to Council and approval by the Mayor or otherwise at the earliest time <br />allowed by law. <br />WILLIAM BUCKHOLTZ <br />Council President <br />First Reading: J~-Hoary 26 , 2004 <br />Second Reading: February 16 ,, 2004 <br />
