,._, .~ Ordinance No. 2004-06 Page 2 (a) This section does not apply to officers, agents or employees of this or any other state or the United States, or to law enforcement officers or certified private security personnel authorized to carry weapons or dangerous ordnance and acting within the scope of their duties. (a) This section shall not apply if any weapon in subsection , (a) hereof was part of a public weapon display, show or exhibition, or was in possession of a person participating in an organized match, competition or practice session. I. Any affirmative defense available under Section 549.02(c) shall constitute an affirmative defense to a charge under this section, provided that the actor is not otherwise prohibited by law from . having such weapon.. Whoever violates this section is guilty of possessing certain weapons at or about public places, a misdemeanor of the first degree. SECTION 2. All other Codified Ordinances of Mayfield Village shall remain as presently drafted unless inconsistent with this ordinance. SECTION 3. The Council finds and determines that all formal actions of this Council relating to the adoption of this Ordinance have been taken at open meetings of this Council; and that deliberations of this Council and of its committees, resulting in such formal action, took place in meetings open to the public, in compliance with all statutory requirements including the requirements of Section 121.22 of the Ohio Revised Code. SECTION 4. This Ordinance is hereby declared to be an emergency measure immediately necessary for the health, safety and welfare of the residents of Mayfield Village, Ohio. It shall, therefore, take effect immediately upon the passage by the affirmative vote of not less than five (5) members elected to Council and approval by the Mayor or otherwise at the earliest time allowed by law.
