Agreement Between Mayfield Village, Ohio and the International Association Firefighters, Loca12619 <br />ARTICLE 30 <br />SHIFT EXCHANGE <br />Section 30.1. Employees shall have the right to exchange shifts with the Fire Chief's permission, <br />when the change does not interfere with the operation of the Fire Department and the number of <br />paramedics on duty does not fall below two (2) and the resulting shift exchange does not result in the <br />payment by the Village of overtime to any employees. Exchanges maybe for the entire twenty-four <br />(24) hour shift, or any part thereof, in minimum increments of one (1) hour. <br />Section 30.2. All requests for shift exchanges must be submitted in writing to the Fire Chief no later <br />than twenty-four (24) hours in advance of the requested exchange. All requests must be signed by the <br />person requesting the shift exchange and also include the name of the person responsible for covering <br />the hours exchanged. . <br />ARTICLE 31 <br />APPLICATION <br />Section 31.1. The Employer agrees that the provisions of this Agreement, along with all work rules <br />and other appropriate regulations, will be administered on a fair and non-discriminatory basis and that <br />such rules or regulations shall not be inconsistent with this Agreement. <br />ARTICLE 32 <br />OBLIGATION TO NEGOTIATE <br />Section 32.1. The Employer and the Union acknowledge that, during negotiations which preceded this <br />Agreement, each had the unlimited right and opportunity to make demands and proposals with respect <br />to any subject or matter not removed by law from the area of collective bargaining and that the <br />understandings and agreements arrived at by the parties after the exercise of that right and opportunity <br />are set forth in this Agreement. <br />Section 32.2. Therefore, for the life of this Agreement, the Employer and the Union each voluntarily <br />and unqualifiedly waives the right, and each agrees that the other shall not be obligated to negotiate <br />collectively with respect to any subject or matter referred to, or covered in this Agreement, or with <br />respect to any subject or matter not specifically referred to or covered in this Agreement, even though <br />such subjects or matters may not have been within the knowledge or contemplation of either or both of <br />the parties at the time they negotiated and signed this Agreement. <br />Section 32.3. This Article shall not operate to prevent negotiations over any subject the parties may <br />mutually agree to negotiate during the term of this Agreement. <br />Page 28 of 35 <br />
