Agreement Between Mayfield Village, Ohio and the International Association Firefighters, Local 2619 <br />ARTICLE 4 <br />DUES DEDUCTIONS <br />Section 4.1. During the term of this Agreement, the Employer shall deduct regular monthly <br />Union dues from the wages of those employees who have voluntarily signed dues deduction <br />authorization forms permitting said deductions. The dues deduction-shall be made from the <br />first paycheck of each month. <br />Section 4.2. A check in the amount of the total dues ,withheld from those employees <br />authorizing a dues deduction shall be tendered to the Treasurer of the Union within fifteen <br />(15) days from the date of making said deductions. <br />Section 4.3., The Union hereby agrees to hold the Employer harmless from any and all <br />liabilities or damages which may arise from the performance of its obligations under this <br />Article and the Union shall indemnify the Employer for any such liabilities that may arise. <br />ARTICLE 5 <br />MANAGEMENT RIGHTS <br />Section 5.1. It is agreed that the Employer reserves all the customary rights, privileges, or <br />authority of management, except as modified by the terms of this Agreement including, but <br />not limited to, the following: <br />Determine matters of inherent managerial policy which include, but are not limited to, <br />areas of discretion or policy, such as the functions and programs of the public <br />employer, standards of services, its overall budget, utilization of technology and <br />organizational structure; <br />2. Supervise, evaluate, or hire employees. <br />3. Maintain and improve the efficiency and effectiveness of governmental operations; <br />4. Determine the overall methods, process, means or personnel by which governmental <br />operations are to be conducted; <br />5. Suspend, discipline, demote, or discharge for just cause, or lay off, transfer, assign, <br />schedule, promote or retain employees; <br />6. Determine the adequacy of the work force; <br />7. Determine the overall mission of the Employer as a unit of government; <br />8. Effectively manage the work force; and <br />9. Take actions to carry out the mission of the public Employer as a governmental unit. <br />Page 3 of 35 <br />
