pressure falls below Customer's pressure. A fourth Check Valve shall be installed <br />in series with the Register Meter at the SOM Center Road/White Road <br />intersection, but manual opening of the isolation valves by Purveyor will be <br />required to allow water to flow through the Register Meters in accordance with <br />the processes set forth in Article II of City Contract No. 43125 between Purveyor <br />and Customer. <br />C. Purveyor shall own, maintain, and be in exclusive control of the <br />Meter, the Vault and the Check Valves, at the expense of Purveyor. <br />ARTICLE II. LIMITATION OF LIABILITY <br />Customer and Mayfield Village acknowledge and agree that <br />Purveyor shall not be liable for any losses incurred by Customer, Mayfield Village, <br />or any other party, resulting from the failure of the Check Valves or any other <br />hardware installed to implement this Agreement. Purveyor's liability to Customer <br />or Mayfield Village shall be determined solely by reference to the applicable <br />water service agreements between Purveyor and Customer and Mayfield Village. <br />ARTICLE III. PAYMENTS <br />A. Customer shall bill Purveyor for any water flowing through the Credit <br />Meter at the master meter rates established in Contract No. 43125 (Attached <br />hereto as Exhibit'~A"). Customer shall waive any and all fees related to <br />installation and/or operation of the Meter, including back-up or standby fees. <br />B. Purveyor shall compensate Customer for any water flowing through <br />the Credit Meter at the rates established in Contract No. 43125 by <br />4 <br />
