RESOLUTION NO. 94-17 <br />INTRODUCED BY: Mayor Rinker and Council as a Whole <br />AN IIKERGENCY RESOLUTION <br />EXTENDING THE SPECIAL U-6 USE PERMIT TO <br />MAN'S HAIR PREVIOUSLY GRANTED TO USE CERTAIN <br />PREMISES FOR A HAIRCUTTING BUSINESS FOR A <br />PERIOD OF THREE (3) YFARS <br />WHE?REAS, Man's Hair has previously requested that certain premises <br />located at 6571 Wilson Mills Road be used for a hair cutting business <br />and now wishes to extend that use for another three (3) years; and <br />WHEREAS, the said premises are located within a use district zoned <br />for special office building use; and <br />WHEREAS, the Mayor and Council acknowledge that, pursuant to the <br />provisions of Section 1149.02 of the Codified Ordinances of Mayfield <br />Village, entitled "Use District Exemptions" the Class U-6 use may be <br />permitted in any use district; and <br />WHEREAS, on May 6, 1991, the Planning and Zoning Commission <br />recommended to Council that a special permit be granted to Man's Hair <br />to operate a liaircutting business in compliance with certain conditions <br />and Council approved that permit through Resolution 91-41; and <br />WHEREAS, Man's Hair has requested an extension of the special use <br />permit for another three (3) years; and <br />WHEREAS, it has been determined by Council that such extension <br />would substantially serve the public convenience and welfare and will <br />not substantially or permanently injure the appropriate use of the <br />neighboring properties. <br />NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF MAYFIELD VILLAGE, <br />-0HI0, THAT: <br />' SECTION 1. Council finds that the use of the property located at <br />?'.;.,6571 Wilson Mills Road as a haircutting business will substantially <br />•..:4serve the public convenience and welfare and will not substantially or <br />.permanently injure the appropriate use of the neighboring property, and <br />, further that such use will not be injurious, obnoxious or offensive by <br />reason of omission of refuse water, odor, dust, fumes, vibrations, <br />smoke, gas, noise, or otherwise and will not be dangerous or harmful to <br />life, health, property or morals and will not cause undue congestion on <br />. the public highways. <br />SECTION 2. Council hereby renews the permit and approval <br />recommended by the Planning and Zoning Commission of Mayfield Village <br />on May 6, 1991, to Man's Hair, to operate a haircutting business as a <br />Special U-6 Use Permit upon the premises, subject to the conditions <br />hereinafter set forth. <br />SECTION 3. The Special Use Permit granted herein is subject to the <br />following terms and conditions: <br />A. Such premises shall be inspActed on an annual basis by the <br />Building and Fire Inspectors. <br />B. The permit granted herein shall be effective only as long as <br />Sandy Mancini remains as the owner of such business.
