RESOLUTION NO. 94- 17 <br />i PAGE TWO C. That there will be no retail sales on such premises during the <br />period of such permit. <br />D. The business know as Man's Hair will only occupy 800 square <br />feet of space on such premises. <br />E. The permittee shall only erect signs on the premises subject <br />to the approval of the Building Inspector and the Architectural Review <br />Board. <br />F. There will not be more than two (2) employees on the premises <br />during any one time. <br />G. This permit may be revoked for any period of time or revoked <br />by the Planning and Zoning Commission upon ten(10) days written notice <br />and hearing for any one or more of the following reasons: <br />(1) Failure to comply with any laws or ordinances <br />applicable to the business and operation of the center; <br />(2) Failure to pay any taxes due to Mayfield Village in <br />connection with the business of the Permittee; <br />(3) Operation of the business authorized by this Permit in <br />a manner determined by the Planning and Zoning <br />Commission to be detrimental to the health, safety, <br />morals or welfare of the residents of Mayfield Village <br />or in such a manner as to constitute a nuisance, or <br />permitting the grounds or buildings to become unsafe or <br />unsightly. <br />SECTION 4. The Permittee shall have no more than ninety (90) days <br />to comply with any violation of the terms and conditions set forth <br />hereinabove, said ninety (90) day period to commence after the Permittee <br />receives written notice from the municipality of such violation. <br />SEGTION 5. The Special Use Permit granted herein shall be in force <br />and effect for a period of three (3) years beginning May 6, 1994. <br />SECTION 6. The Council finds and determines that all formal <br />actions of the Council relating to the adoption of this Resolution have <br />been taken at open meetings of this Council; and that deliberations of <br />this Council and of its committees, resulting in such formal action, <br />took place in meetings open to the public in compliance with all <br />statutory recjuirements including the requirements of Section 121.22 of <br />the Ohio Revised Code. <br />SECTION 7. This Resolution is hereby declared to be an emergency <br />measure necessary for the immediate preservation of the health, safety <br />and welfare of the residents of Mayfield Village. It shall, therefore, <br />take effect immediately upon passage by the affirmative vote of not less <br />than five (5) members elected to Council and approval by the Mayor or <br />otherwise at the earliest time allowed by law. <br />JO CINCO, <br />C cil President
