ORDINANCE NO. 94-12 <br />` INTRODUCED BY: MAYOR RINKER & COUNCIL AS A WHOLE. <br />AN EMERGENCY ORDINANCE <br />CREATING A NEW CHAPTER 766, CABLE TELEVISION <br />REGULATION OF BASIC SERVICE RATES AND CHARGES, <br />SETTING FORTH ADOPTION OF FCC RATE REGULATIONS <br />FOR ENFORCEMENT BY THE VILLAGE <br />WHEREAS, the Federal Communications Commission (hereinafter <br />"FCC") has adopted rate regulations pursuant to 47 U.S.C. § 543(b); <br />WHEREAS, the Village of Mayfield applied for certification to <br />regulate basic cable service rates on October 8, 1993, and agreed <br />therein to adopt within one hundred twenty (120) days of <br />certification and administer regulations with respect to basic <br />cable service that are consistent with the regulations adopted by <br />the FCC pursuant to 47 U.S.C. § 543(b); <br />WHEREAS, in said application for certification the Village of <br />Mayfield agreed to adopt regulations applicable to rate regulation <br />proceedings which provide a reasonable opportunity for <br />consideration of the views of interested parties. <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF MAYFIELD <br />VILLAGE, OHIO, THAT: <br />SECTION 1. That existing Part Seven, Business Regulation <br />Code, of the Codified Ordinances of the Village of Mayfield, be and <br />the same is hereby amended by the addition of new Chapter 766, <br />Cable Television Basic Services Rates and Charges Regulations, to <br />read as follows: <br />CHAPTER 766 <br />Cable Television Basic Service Rates And Charges Regulations <br />766.01 Adoption. <br />766.02 File and Distribution Copies. <br />766.03 Public Comment. <br />766.01 Adoption of FCC Basic Cable Service Rates and Charges. <br />There is hereby adopted by the municipality and incorporated as if <br />fully set out, herein, for the purpose of enforcement, the basic <br />cable service rate regulations adopted by the Federal Communication <br />Commission pursuant to 47 U.S.C-. 543(b), and codified at 47 C.F.R. <br />§ 76.900-985; and any and all amendments or additions thereto, <br />either by the FCC or the Village of Mayfield consistent with FCC <br />policy.
