? ORDINANCE NO. 94-12 ` INTRODUCED BY: MAYOR RINKER & COUNCIL AS A WHOLE. AN EMERGENCY ORDINANCE CREATING A NEW CHAPTER 766, CABLE TELEVISION REGULATION OF BASIC SERVICE RATES AND CHARGES, SETTING FORTH ADOPTION OF FCC RATE REGULATIONS FOR ENFORCEMENT BY THE VILLAGE WHEREAS, the Federal Communications Commission (hereinafter "FCC") has adopted rate regulations pursuant to 47 U.S.C. § 543(b); WHEREAS, the Village of Mayfield applied for certification to regulate basic cable service rates on October 8, 1993, and agreed therein to adopt within one hundred twenty (120) days of certification and administer regulations with respect to basic cable service that are consistent with the regulations adopted by the FCC pursuant to 47 U.S.C. § 543(b); WHEREAS, in said application for certification the Village of Mayfield agreed to adopt regulations applicable to rate regulation proceedings which provide a reasonable opportunity for consideration of the views of interested parties. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF MAYFIELD VILLAGE, OHIO, THAT: SECTION 1. That existing Part Seven, Business Regulation Code, of the Codified Ordinances of the Village of Mayfield, be and the same is hereby amended by the addition of new Chapter 766, Cable Television Basic Services Rates and Charges Regulations, to read as follows: CHAPTER 766 Cable Television Basic Service Rates And Charges Regulations 766.01 Adoption. 766.02 File and Distribution Copies. 766.03 Public Comment. 766.01 Adoption of FCC Basic Cable Service Rates and Charges. There is hereby adopted by the municipality and incorporated as if fully set out, herein, for the purpose of enforcement, the basic cable service rate regulations adopted by the Federal Communication Commission pursuant to 47 U.S.C-. 543(b), and codified at 47 C.F.R. § 76.900-985; and any and all amendments or additions thereto, either by the FCC or the Village of Mayfield consistent with FCC policy.
