Jurisdictions wishing to adopt the BOCA Nutional Prnperty Mainrenunce Code11993 as an enforceable regulation goveming existing structures and premises should insure that ceRain factual infornnation is included in the adopting ordinance at the time adoption is being considered by the appropriate govemmental body. The following sample adoption ordinance addresses several key elements of a code,adoption ordinance, including the information required for insertion into the code text. SAMPLE OFiDINATICE FOR ADOPTfON OF THE 1993 BOCA NATION,4L PROPERTY fiflAl(dTENANCE CODE Bill Number Ordinance Plumber AN ORDINANCE ESTABLISHING THE MINIMUM REGULATIONS GOVERNING THE CONDITIONS AND MAIN- TENANCE OF ALL PROPERTY, BU[LDINGS AND STRUCTURES; BY PROVIDING THE STANDARDS FOR SUPPLIED UTILITIES AND FACILITIES AND OTHER PHYSICAL THINGS AND CONDITIONS ESSENTIAL TO INSURE THAT STRUCTURES ARE SAFE, SANITARY AND FIT FOR OCCUPATION AND USE; AND THE CONDEMNATION OF BUILD- INGS AND STRUCTURES UNFIT FOR HUMAN OCGUPANCY AND USE AND THE DEMOLITION OF SUCH STRUC- TURES; KNOWN AS THE PROPERTY MA[NTENANCE CODE. Inc., be and is hereby adopted as the Property Maintenance Code of the (Nunre of Jiirrsdic•tinn), in the State of (Srate Name); for the control of buildings and structures as herein provided; and each and all of the regulations, provisions, penalties, conditions and terms of said BOCA National Property Maintenance Code are hereby referred to, adopted, and made a part hereof, as if fully set out in this Ordinance, with the additions, insertions, deletions and changes, if any, prescribed in Section 3 of this ordinance. SEC"TION 2. INCONSISTENT ORDINANCES REPEALED. That nothing in this Ordinance or in the Property Maintenance Code hereby adopted shall be construed to affect any suit or proceeding impending in any court, or any rights acyuired, or liability incurred, or any cause or causes of action acquired or existing, under any act or ordinance hereby repealed as cited in Section 2 of this Ordinance; nor shall any just or legal right or remedy of any character be lost, impaired or affected by this Ordinance. SECTION 5. DATE OF EFFFCT. That the (Jurisclic•tinn'.r Keeper of Rec•ads) shall cenify to the adoption of this Ordinance, and cause the same to be published as required by law; and this Ordinance shall take effect and be in force from and after its approval as required by law. ix
