ORDINANCE NO. 94-35 (As Amended) <br />INTRODUCED BY: Mayor Rinker and Council as a Whole <br />AN EMERGENCY ORDINANCE <br />AMENDING PORTIONS OF SECTION 1157.08 OF THE <br />CODIFIED ORDINANCES OF THE VILLAGE OF MAYFIELD <br />WHICH REGULATES FENCING IN CERTAIN ZONING <br />DISTRICTS. <br />WHEREAS, Council has deemed it to be in the best interests of <br />the health, safety and welfare of all of the Village residents to <br />amend certain portions of the Codified Ordinances that relate to <br />fencing. <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF MAYFIELD <br />VILLAGE, OHIO, THAT: <br />SECTION 1. That Section 1157.08 of the Codified Ordinances of <br />the Village of Mayfield shall be amended with regards to certain <br />portions of subsection (b) and by adding new section (f) as <br />follows: <br />1157.08 FENCES; PERMITS; FEE. <br />?c * * <br />(b) In Side And Rear Yards. In side yards and rear <br />yards in class U-1, U-2, U-3 AA Use Districts the only fences <br />permitted shall be as follows: <br />Open fences not over feur ana ene-ha' f <br />five feet in height shall be permitted along the sideline of rear <br />yards and along the rear lot line, provided such fences shall have <br />uniformly spaced openings aggregating twenty-five percent of their <br />surface areas between residential properties. <br />However, an open or a closed fence not over eight feet in <br />height may be placed along the rear or side line which separates <br />residential property from property used for non-residential <br />purposes, subject to the written approval of the Building <br />Commissioner, who shall not give his approval if he finds that such <br />proposed fence is unsafe or unsightly or that it obstructs <br />necessary light and air from adjacent property or that in some <br />manner it does not conform with the ordinances of the Municipality. <br />On any side or rear yard fence, the supporting rails and <br />posts shall face the interior of the property of the owner of the <br />fence and shall not face the adjacent property; the finished side <br />(as contrasted with the rough or unfinished side) of the fence <br />shall face the property of the adjacent property owner. <br />(z)
