ARTICLB 38 <br />PREVAILING RIGHTS <br />Section 38.1. <br />employees at <br />ahaii r-emain <br />F.O.P. <br />All rights, privileges and working conditions enjoyed by the <br />the present time which are not included in this Agreement <br />unchanged unless by mutual consent of both the Village and the <br />ARTICLB 39 <br />OBLIGATION TO NSGOTIATS <br />Section 39.1. The Employer and the F.O.P. acknowledge that during <br />negotiations which preceded this Agreement, each had the unlimited right <br />and opportunity to make demands and proposals with respect to any subject <br />or matter not removed by law from the area of collective bargaining and <br />that the understandings and agreements arrived at by the parties after the <br />exercise of that right and opportunity are set forth in this Agreement. <br />ARTICLB 40 <br />APPLICATION <br />Section 40.1. The Employer agrees that the provisions of this Agreement, <br />along with all work rules and other appropriate regulations, will be <br />administered on a fair and non-discriminatory basis and that sueh rules or <br />regulation shall not be inconsistent with this Agreement. This Agreement <br />represents the entire agreement between the Employer and the F.O.P. <br />ARTICLB 41 <br />TERM OF AGRSEMENT/NSGOTIATION PHOCSDURB <br />Section 41.1. This Agreement shall be effective as of January 1, 1994, and <br />shall remain in full force and in effect until December 31, 1996. <br />Section 41.2. This Agreement shall continue from year to year beyond the <br />original term hereof unless either party notifies the other in writing of <br />its intent to amend, modify, or terminate the Agreement by certified U.S. <br />mail, not later than ninety (90) days nor earlier than one hundred twenty <br />(120) days prior to the expiration date of the Agreement. <br />Section 41.3. The parties shall meet at a place and time mutually <br />convenient within fourteen (14) days after receipt of such notice in order <br />to begin negotiations in good faith for a successor agreement, pursuant to <br />the following-guidelines: <br />A. Location of ineetings <br />• Meetings will be held on the premises of the Employer. <br />B. Dates and Times of ineetings <br />• Sessions will be scheduled by mutual agreement on an as needed basis <br />and will for three (3) hours maximum in duration. If further meeting <br />time is required following adjournment, nothing herein shall limit the <br />parties from mutually consenting to schedule a limited agenda meeting <br />immediately following the regularly scheduled meeting. <br />7_ 5 ----
