ARTICLB 3 <br />AGSNCY SHOP/DUES DLDUCTION <br />Section 3.1. Upon the effective date of this agreement, or within thirty <br />(30) days thereafter, all employeea in the bargaining unit shall either <br />become due-paying members of the F.O.P., or, as a condition of continued <br />employment, remit to the F.O.P., a fair share fee, to be determined in <br />accord with the provisions of Ohio Revised Code Section 4117.09 (C). Any <br />newly hired employees in the bargaining unit shall, within thirty (30) days <br />after their appointment becomes permanent, either elect to become members <br />of the F.O.P. or remit the fair share fee. Nothing in this Article shall be <br />deemed to require any employees to become a member of the F.O.P. <br />Section 3.2. The Employer aqrees to deduct P.O.P. dues from any F.O.P. <br />member of the bargaining unit who provides written authorization for a <br />payroll dues deduction. Fair share fees shall be deducted pursuant to Ohio <br />Revised Code Section 4117.09 (C) and the F.O.P. shall indemnify the <br />Employer and hold it harmless against any and all claims, demands, suits or <br />other liability that may arise by reason of any action of the Employer in <br />complying with the provisions of this Article. <br />Deductions for dues and fair share fees will be made at least on a monthly <br />Village <br />basis, and paid?o T?oviding , aFlOist. (Mayfield <br />with the Employe P <br />fair share fee deductions have been made. <br />Section 3.3. A check in the amount of the total dues withheld from those <br />authorizing dues me tendered tmakingassaid <br />of the <br />deductions. <br />ARTICLB 4 <br />MANAGSMLmT RIGHTS <br />Section 4.1. It is agreed that the Employer reserves all the cuatomary <br />rights, privileges, authority management, following:by the <br />terms of this Agreement <br />A. determine matters of inherent managerial policy which include, <br />but are not limited to, areas of discretion or policy, such as <br />the functions and programs of the publiC employer, standards of <br />service, its overall budget, utilization of technology, and <br />organizational structure; <br />B. direct, supervise, evaluate, or hire employeesj <br />C. maintain and improve the efficiency and effectiveness of <br />governmental operations; <br />D. determine the overall methods, process, means, or personnel by <br />which governmental operations are to be conductedt <br />E. suspend, discipline, demote, or discharge for just causej or <br />layoff, transfer,,assign schedule, promote, or retain employees; <br />F. determine the adequacy of the work forcej <br />2
