<br />e -day of 19, , (hereinafter referred to as "County").
<br />~'6'ITNESSETH
<br />WHEREAS, the Housing and Community Development Acts of 1974, 1977, 1980, 1983, 1987 and 1992 as
<br />amended, provides an entitlement of Community Development Block Grant (CDBG) funds for Community
<br />Development purposes for Urban Counties; and
<br />WHEREAS, the National Affordable Housing Act of 1990, 1992 as amended provides an entitlement
<br />of HOME Investment Partnerships Program (HOME Program) funds for Affordable Housing purposes for
<br />Urban Counties and Consortiums; and
<br />WHEREAS, Cuyahoga County may be designated as an Urban County provided that it secures
<br />Cooperation Agreements with various Political Subdivisions in Cuyahoga County; and
<br />WHEREAS, the Chief Executive Officer and the Legislative Body of the Political Subdivision of
<br />the Village of Mayfield desires the use of "CDBG Urban County Entitlement and HOME Program
<br />Funds" for needed public improvements in Cuyahoga County and its municipalities; and
<br />WHEREAS, the County shall prepare Application for FY '94, '95, & '96 Urban County CDBG and HOME
<br />Program funds and Program Income generated from the expenditure of CDBG funds pursuant to the
<br />aforementioned Act for the FY '94, '95, & '96 Program Years; and
<br />WHEREAS, no less than forty percent (40%) of the total Urban County Entitlement Funds for
<br />Cuyahoga County will be expended by the Cuyahoga County Board of Commissioners on behalf of the
<br />participating political subdivisions to finance through a Municipal Grant Program eligible
<br />Community Development activities, programs, and projects in said participating political
<br />subdivisions; and
<br />NOW, THEREFORE, the Political Subdivision and the County do hereby promise and agree;
<br />The County will on behalf of the Political Subdivision execute essential Community Development .
<br />and Housing Assistance applications, plans, and programs, and projects eligible under the Housing
<br />and Community Development Acts of 1974, 1977, 1980, 1983, 1987 and 1992 and the National Affordable
<br />Housing Act of 1990, 1992 as amended, and the County and the Political Subdivision agree to
<br />"Cooperate to undertake, or assist in undertaking, community renewal and lower income housing
<br />assistance activities, specifically urban renewal and publicly assisted housing", as approved by
<br />the Supreme Court of Ohio in Bursetle V. Rich, 159 O.S. 13, pursuant to the Application, and
<br />publicly assisted housing pursuant to the Application,
<br />The County and Political Subdivision will take all the actions necessary to comply with the
<br />provisions of Section 104(b) of Title I of the Housing and Community Development Act of 1974, as
<br />amended, including Title VI of the Civil Rights Act of 1964, Title VIII of the Civil Rights Act of
<br />1968, Executive Order 11988, the Fair Housing Act, Section 109 of Title I of the Housing and
<br />Community Development Act of 1974 as amended, National Environmental Policy Act of 1969, and other
<br />applicable laws.
<br />The Political Subdivision understands that by executing this agreement that it:

<br />receives a HOME formula allocation and; v
<br />2, may not apply for grants under the Small Cities or State CDBG Programs from appropriations
<br />for fiscal years during the period in which it is participating in the urban county's CDBG
<br />program; and
<br />• The Political Subdivision must certify that they have adopted and enforces;
<br />1, a policy prohibiting the use of excessive force by law enforcement agencies within its
<br />jurisdiction against any individuals engaged in non-violent civil rights demonstrations;

<br />2. a policy of enforcing applicable State and local laws against physically barring entrance
<br />to or exit froth a facility or location which is the subject of such non-violent civil
<br />rights demonstrations within jurisdictions,
