Further, -Urban County CDBG funds are prohibited for "activities in or in support of any cooperating unit of general local government that does -not affirmatively further fair housing within its own jurisdiction or that rmpedes the county's actions to comply with its fair housing certification" . The period of time of this Agreement for the use of CDBG and HOME Program funds and program income generated from the expenditure of such funds shall be from the first day of the twentieth program year, (June 1, 1994) through and including the last day of the twenty-second program year (May 31, 1997) as described by the Application for FY '96 funds. The period of this Agreement may extend beyond May 31, 1997 if additional time is required for the expenditure of the CDBG and HOME Program funds awarded to the Political Subdivision through the Municipal Grant Program. The terms of performance for such projects will be governed by the separate written agreement executed between the County and the Political Subdivision for each individual project. This Agreement will be automatically renewed for successive three-year qualification periods, unless the County or the participating Political Subdivision provides written notice that it elects not to participate in the new qualification period. The County will notify the participating Political Subdivision in writing by the date specified in HUD's urban county qualification notice for subsequent qualification periods. Failure by either the County or the Political Subdivision to adopt an amendment to the Agreement incorporating all changes necessary to meet the requirements for cooperation agreements set forth for a subsequent three-year urban county qualification period, and to submit the amendment to HUD as provided in the urban county qualification notice will void the automatic renewal of such qualification period. This Agreement will remain in effect until the CDBG and HOME funds and income received with respect to this qualification period and any successive qualification period are expended and the funded activities are completed, and the County and Political Subdivision may not terminate or withdraw from the Agreement while the Agreement remains in effect. Pursuant to Community Development Block grant regulations found at 24 CFR 570.501(b) the Political Subdivision is subject to the same requirements applicable to subrecipients, including the requirement for a written agreement set forth in 24 CFR 570.503. The County may terminate this agreement and such additional supplemental agreements and shall be held harmless by the political subdivision in the event that the Secretary of HUD shall; a. Withdraw funds allocated to the County under its application for program activities that substantially prevents performance of the CDBG or HOME Program in the Urban County Communities; b. Terminate the County's funding allocation pursuant to an Act of Congress; or, c. Fail to approve a grant application filed by the County.
