._ <br />Y~ .. <br />Further, -Urban County CDBG funds are prohibited for "activities in or in support of any <br />cooperating unit of general local government that does -not affirmatively further fair housing <br />within its own jurisdiction or that rmpedes the county's actions to comply with its fair housing <br />certification" . <br />The period of time of this Agreement for the use of CDBG and HOME Program funds and program <br />income generated from the expenditure of such funds shall be from the first day of the twentieth <br />program year, (June 1, 1994) through and including the last day of the twenty-second program year <br />(May 31, 1997) as described by the Application for FY '96 funds. <br />The period of this Agreement may extend beyond May 31, 1997 if additional time is required for <br />the expenditure of the CDBG and HOME Program funds awarded to the Political Subdivision through the <br />Municipal Grant Program. The terms of performance for such projects will be governed by the <br />separate written agreement executed between the County and the Political Subdivision for each <br />individual project. <br />This Agreement will be automatically renewed for successive three-year qualification periods, <br />unless the County or the participating Political Subdivision provides written notice that it elects <br />not to participate in the new qualification period. The County will notify the participating <br />Political Subdivision in writing by the date specified in HUD's urban county qualification notice <br />for subsequent qualification periods. Failure by either the County or the Political Subdivision to <br />adopt an amendment to the Agreement incorporating all changes necessary to meet the requirements <br />for cooperation agreements set forth for a subsequent three-year urban county qualification period, <br />and to submit the amendment to HUD as provided in the urban county qualification notice will void <br />the automatic renewal of such qualification period. <br />This Agreement will remain in effect until the CDBG and HOME funds and income received with <br />respect to this qualification period and any successive qualification period are expended and the <br />funded activities are completed, and the County and Political Subdivision may not terminate or <br />withdraw from the Agreement while the Agreement remains in effect. <br />Pursuant to Community Development Block grant regulations found at 24 CFR 570.501(b) the <br />Political Subdivision is subject to the same requirements applicable to subrecipients, including <br />the requirement for a written agreement set forth in 24 CFR 570.503. <br />The County may terminate this agreement and such additional supplemental agreements and shall <br />be held harmless by the political subdivision in the event that the Secretary of HUD shall; <br />a. Withdraw funds allocated to the County under its application for program activities that <br />substantially prevents performance of the CDBG or HOME Program in the Urban County <br />Communities; <br />b. Terminate the County's funding allocation pursuant to an Act of Congress; or, <br />c. Fail to approve a grant application filed by the County. <br />IN WITNESS WHEREOF, the Political Subdivision and the County have caused this Agreement to be <br />executed by their respective officers thereunto duly authorized as of the day and year first above <br />written. <br />Approved as to form.
