Proposed revisions to C.O. Section 1149.02 - Use District Exceptions <br />(a)Temporary and Conditional Use Permit-A permit qrantinq an <br />exception to the Villaqe's established use districts and pursuant to <br />subsection (c)(2) hereunder that will allow uses not expresslv <br />permitted to be located in anv Use District excludinq a Sinqle-Familv <br />House District, and subiect to specified conditions. <br />(b)Special Use Permit- A permit qrantinq an exception to the <br />Villaqe's established use districts and pursuant to subsection (c)(3) <br />hereunder that will allow a use set forth in 1153.02(e) as a U-5 use to <br />be located in a Local Business District or a use set forth in 1153.02(f) <br />as a U-6 use to be located in anv use district, and subiect to specified <br />conditions. <br />04 (c)Except as otherwise provided in the Charter, the Planning <br />and Zoning Commission may in specific cases-, after public notice and <br />hearing, and subject to such conditions and safeguards as the <br />Commission may establish, determine and vary the application of the <br />use district exceptions herein established bv qrantinq temporary and <br />conditional use or special use permits, which permission shall be <br />confirmed by resolution of Council before becoming effective, in the <br />following respects: <br />(1) Permit the extension of a nonconforming use of a <br />building upon the lot occupied by such use of building at the time of <br />the passage of this Zoning Code; <br />(2) Grant temporarv and conditional permits in <br />undeveloped and/or underutilized sections of the Municipality, <br />+cmpnrnry a„d nnnr?i+inn?l r.,r?crmi??s ?.for not more than two year <br />..? ?u?.,? ,.,., .,, , , ,. <br />periods for structures and uses that do not conform to the regulations <br />herein prescribed for the use district in which they are to be located. <br />Any such permit granted shall expire on December 31 St of the next <br />even numbered year following the year in which the permit is granted. <br />It will be the responsibility of the permit holder to make application for <br />review and approval of an additional extension no later than <br />November 1 St in the year that expiration is scheduled to occur. <br />EXHIBIT A
