(3) Grant special use permits Permit to locate a Class U-5 <br />use in a Local Business District and permit the location of a Class U-6 <br />use in any use district. m,mR the <br />j? i?m°ntho DlaRninrr anr! 7nninrYCom i?inr+ ' cuhs+an+ially <br />sowo +ho r+uhlin nnr?vonionno anr! wolfaro api^l yiill nn+ suhs+an+iall?i nr <br />, <br />e GbRGX-iGWG <br />nr nffor+ ivc hy roa nR nf cmic?inn nf rcfuac wa+oro nrlnrce rluet fumos, <br />> smoke, gas, > f <br />harmful +n lifc, hoal+h, prnpcrFy nr mnrals, anrl will nnt nauce an?No <br />r+n?tic+inn nR +ho puhlin hinhw <br />s. <br />(4) Temporary and conditional use or special use <br />permits shall only be qranted provided such use in such location will, <br />in the iudqment of the Planning and Zoning Commission, <br />substantially serve the public convenience and welfare and will not <br />substantially or permanently injure the appropriate use of the <br />nei h?ing propertv and provide further that such permitted use is <br />not iniurious obnoxious or offensive bv reason of emission of refuse <br />water, odors dust, fumes, vibrations, smoke, qas, noise, or <br />otherwise and is not danqerous or harmful to life, property or morals, <br />and will not cause undue conQestion on the public hiqhwavs. <br />(5)44} In the event that Council grants a special use <br />permit under this section, and imposes a time period of review of the <br />permit holder=s performance, such review period shall conform with <br />all other speGoal temporary and conditional use permits as referred to <br />under subsection WLc) (2) hereinabove. <br />{-b-}fdI A Class U-6 use existing in any use district at the time of <br />the passage of this Code shall be deemed an authorized use upon <br />the lot developed to such use at the time of the passage of this Code. <br />Le) In evaluatina the reasonableness of a proposed Use District <br />Exception the Planning and Zoninq Commission shall review the <br />facts and circumstances of each proposed use and find that the <br />applicant has provided adequate evidence of addressinq the <br />auidelines established bv the Planninq and Zonina Commission as <br />amended from time to time.
