ARTICLE 36 <br />SEVERABILITY <br />Section 36.1. In the event any one or more provision(s) of this Agreement is or are deemed invalid <br />or unenforceable by any final decision of a court or subsequently enacted legislation, that portion(s) <br />shall be deemed severable from the rest of the Agreement and all such other parts of this Agreement <br />shall remain in full force and effect. <br />Section 36.2. If in the event any provision is so rendered invalid, upon written request of either <br />party hereto, the Employer and the F.O.P. shall meet within thirty (30) days for the purpose of <br />negotiating a satisfactory replacement for such provision. <br />Section 36.3. Any negotiated change must be reduced to writing and be signed by both parties to <br />be effective and incorporated into this Agreement. <br />ARTICLE 3 7 <br />PREVAILING RIGHTS <br />Section 37.1. All rights, privileges and working conditions enjoyed by the employees at the <br />present time which are not included in this Agreement shall remain unchanged unless by mutual <br />consent of both the Village and the F.O.P. , <br />ARTICLE 38 <br />OBLIGATION TO NEGOTIATE <br />Section 38.1. The Employer and the F.O.P. acknowledge that during negotiations which <br />preceded this Agreement, each had the unlimited right and opportunity to make demands and <br />proposals with respect to any subject or matter not removed by law from the area of collective <br />bargaining and that the understandings and agreements arrived at by the parties after the exercise <br />of that right and opportunity are set forth in this Agreement. <br />6/1/2006 Page 30 of 36
