ARTICLE 39 <br />APPLICATION <br />Section 39.1. The Employer agrees that the provisions of this Agreement, along with all work <br />rules and other appropriate regulations, will be administered on a fair and non-discriminatory <br />basis and that such rules or regulation shall not be inconsistent with this Agreement. This <br />Agreement represents the entire agreement between the Employer and the F.O.P. <br />ARTICLE 40 <br />TERM OFAGREEMENT /NEGOTIATIONPROCEDURE <br />Section 40.1. This Agreement shall be effective as of January 1, 2006, and shall remain in full <br />force and in effect until December 31, 2008. <br />Section 40.2. This agreement will be extended for one year beginning January 1, 2009 and <br />ending December 31, 2009. <br />Section 40.3. This agreement will be extended further for an additional one year beginning <br />January 1, 2010 and ending December 31, 2010. <br />Section 40.4. This Agreement shall continue from year to year beyond the original term hereof <br />unless either party notifies the other in writing of its intent to amend, modify, or terminate the <br />Agreement by certified U.S. mail, not later than ninety (90) days nor earlier than one hundred <br />twenty (120) days prior to the expiration date of the Agreement. <br />Section 40.5. The parties shall meet at a place and time mutually convenient within fourteen <br />(14) days after receipt of such notice in order to begin negotiations in good faith for a successor <br />agreement, pursuant to the following guidelines: <br />A. Location of ineetings <br />• Meetings will be held on the premises of the Employer. <br />B. Dates and Times of ineetings <br />Sessions will be scheduled by mutual agreement on an as needed basis and will for three <br />(3) hours maximum in duration. If further meeting time is required following <br />adjoununent, nothing herein shall limit the parties from mutually consenting to schedule <br />a limited agenda meeting immediately following the regularly scheduled meeting. <br />6/1/2006 Page 31 of 36
