Agreement between lllayfield Village and F.O.P. Lodge 57 <br />ARTdC'LE 3 <br />AGENCYSHOP/DUES DEDUC7'ION <br />Section 3.1. Upon the effective date of this agreement, or within thirty (30) days thereafter, all <br />employees in the baxgaining unit shall either become due-paying members of the F.O.P., or, as a <br />condition of continued employment, remit to the F.O.P., a fair share fee, to be determined in accord <br />with the provisions of Ohio Revised Code Section 4117.09 (C). Any newly hired employees in the <br />bargaining unit sha11, upon completion of sixty (60) days of employment with the Employer, either <br />elect to become members of the F.O.P. or remit the fair share fee. Nothing in this Article shall be <br />deemed to require any employees to become a member of the F.O.P. The payment of union dues or <br />a fair share fee does not in any way affect the Employer's rights as detailed in Article 7 below. <br />Section 3.2. The Employer agrees to deduct F.O.P. dues from any F.O.P. member of the <br />bargaining unit who provides written authorization for a payroll dues deduction. Fair share fees <br />shall be deducted pursuant to Ohio Revised Code Section 4117.09 (C) and the F.O.P. shall <br />indemnify the Employer and hold it harmless against any and all claims, demands, suits or other <br />liability that may arise by reason of any action of the Employer in complying with the provisions of <br />this Article. <br />Deductions for dues and fair share fees will be made at least on a monthly basis, and paid to <br />Treasurer, F.O.P. Lodge #SZ (Mayf'ield Village Division), with the Employer providing a list of <br />those employees for whom dues and fair share fee deductions have been made. <br />Section 3.3. Total dues withheld from tliose employees authorizing a dues deduction shall be <br />tendered to the Treasurer of the F.O.P. within fifteen (15) days from the date of making said <br />deductions. <br />6/1/2006 Page 2 of 36
