Ch. 1105 <br />Nonconforming defined - see P.& Z. 1113.17 <br />1149.01 ENFORCEMENT. <br />This Zoning Code shall be enforced by the Building Commissioner. <br />(Ord. 159. Passed 5-20-35.) <br />1149.02 USE DISTRICT EXCEPTIONS. <br />(a) Temporary and Conditional Use Permit. A permit granting an exception to the <br />Village's established use districts and pursuant to subsection (c)(2) hereunder that will allow uses <br />not expressly permitted to be located in any use district excluding a Single-Family House District, <br />and subject to specified conditions. <br />(b) Special Use Permit. A permit granting an exception to the Village's established use <br />districts and pursuant to subsection (c)(3) hereunder that will allow a use set forth in Section <br />1153.02(e) as a U-5 use to be located in a Local Business District or a use set forth in Section <br />1153.02(f) as a U-6 use to be located in any use district, and subject to specified conditions. <br />(c) Except as otherwise provided in the Charter, the Planning and Zoning Commission <br />may in specific cases, after public notice and hearing, and subject to such conditions and <br />safeguards as.the Commission may establish, determine and vary the application of the use district <br />exceptions herein established by granting temporary and conditional use or special use permits, <br />which permission shall be confirmed by resolution of Council before becoming effective, in the <br />following respects: <br />(1) Permit the extension of a nonconforming use of a building upon the lot <br />occupied by such use or building at the time of the passage of this Zoning <br />Code; <br />2006 Replacement
