ORDINANCE NO. 97- 19 <br />INTRODUCED BY: Mayor Bruce G. Rinker and Council as a Whole. <br />AN ORDINANCE LEVYING SPECIAL ASSESSMENTS FOR THE <br />IMPROVEMENT OF CERTAIN PROPERTIES IN MAYFIELD <br />VILLAGE BY CONSTRUCTING SANITARY SEWERS, TOGETHER <br />WITH SERVICE CONNECTIONS THEREFOR AND THE <br />NECESSARY APPURTENANCES THERETO, IN WORTON PARK <br />DRIVE, NORTH WOODLANE DRIVE, WOODLANE DRIVE, <br />SOUTH WOODLANE DRIVE AND NORMAN LANE, BETWEEN <br />CERTAIN TERMINI AND DECLARING AN EMERGENCY. <br />WHEREAS, the improvement described in Section 1 has been completed and the <br />final cost of that improvement has been determined; <br />NOW, THEREFORE, BE IT ORDAINED by the Council of Mayfield Village, <br />Cuyahoga County, Ohio, that: <br />Section 1. The special assessments for the cost and expense of constructing sanitary <br />sewers, together with service connections therefor and the necessary appurtenances thereto, in <br />Worton Park Drive from an existing sanitary sewer in Wilson Mills Road to South Woodlane <br />Drive, in North Woodlane Drive from Worton Parlc Drive to Woodlane Drive, in Woodlane <br />Drive from North Woodlane Drive to South Woodlane Drive, in South Woodlane Drive from <br />Woodlane Drive easterly approximately 715 feet and from a point approximately 165 feet <br />westerly of Worton Park Drive easterly approximately 355 feet to the terminus of South <br />Woodlane Drive and in Norman Lane from Worton Park Drive to a point approximately 130 <br />feet easterly of Woodlane Drive in Mayfield Village, Ohio pursuant to Resolution No. 95-28 <br />adopted June 19, 1995, amounting in the aggregate to $633,894.24, which were filed and are <br />on file with the Clerlc of Council, are adopted and confirmed. Those special assessments are <br />levied and assessed upon the lots and lands provided for in Resolution No. 95-28 in the <br />respective amounts set forth in the schedule of special assessments on file, which special <br />assessments are in proportion to the special benefits and are not in excess of any statutory <br />limitation. <br />Section 2. This Council finds and determines that the special assessments are in the <br />same proportion to the estimated special assessments as the actual cost of the improvement is <br />to the estimated cost of the improvement as originally filed. <br />Section 3. The special assessment against each lot or parcel of land shall be payable <br />in cash within 30 days after the passage of this ordinance, or at the option of the owner in 20 <br />annual installments with interest at the same rate as provided in the respective agreements <br />entered into between the Village and (i) the Ohio Water Development Authority and (ii) the <br />Ohio Public Worlcs Commission. All cash payments shall be made to the Director of Finance <br />of this Village. All special assessments remaining unpaid at the expiration of those 30 days <br />shall be certified by the Clerlc of Council to the County Auditor as provided by law to be placed <br />on the tax duplicate and collected as taxes are collected. <br />
