Ex1~~.ib~~ ~ A AGREEMENT WHEREAS, the cities of Lyndhurst, Ohio, Mayfield Heights, Ohio, Highland Heights, Ohio, Pepper Pike, Ohio, Richmond Heights, Ohio, Beachwood, Ohio, the Village of Gates Mills, Ohio and the Village of Mayfield, Ohio (the "participating municipalities") desire to enter into an Agreement which sets forth the terms, conditions, rights, duties and obligations of each of the participating municipalities relevant to establishment of a cooperative venture among said participating municipalities for the development of a Mobile Air Unit and Technical Rescue Team ("MAUTRT"); and WHEREAS, the participating municipalities desire to recognize their respective and joint needs relative to the establishment and maintenance of a Mobile Air Rescue Unit to serve the needs of the MAUTRT; and WHEREAS, to the extent that the terms, conditions, rights, obligations and duties of the aforesaid participating municipalities can be determined at this time, the participating municipalities enter into this Agreement with the understanding that any terms, conditions, rights, obligations and duties not specifically set forth herein are subject to further agreement between the aforesaid participating municipalities, but that in any such supplemental agreement, the spirit and intent of this Agreement shall be carried out; and WHEREAS, the participating municipalities desire to contract with each other to expand the use of the Mobile Air Rescue Unit to include, but not be limited to the services of Rope Rescue, Water and Ice Rescue, Trench Rescue and Confined Space Rescue; and WHEREAS, each of the aforesaid municipalities have the authority to contract and enter into an agreement pursuant to Article XVIII of the Ohio Constitution and Ohio Revised Code Section 715.02 relative to inter-governmental agreements; NOW, THEREFORE, the participating municipalities agree as follows: The participating municipalities do hereby agree to develop a Mobile Air Unit and Technical Rescue Team and Mobile Air Unit which shall be available to, and used by, the participating municipalities as needed without reference to any particular formula or timetable for such availability or use. The Mobile Air Unit shall be dispatched only to a participating municipality by the employees of the particular municipality or the incident commander of the host municipality needing the Mobile Air Unit. 2. The Mobile Air Unit shall be officially known as the Hillcrest Mobile Air and ~ Rescue Unit ("Mobile Air Rescue Unit 577"). i 1
