• Section 12. EMERGENCY USE OF FACILITIES. <br />12.1 Emergencv Provisions <br />The Permittee shall, in the case of any Village, State, or national emergency or disaster, upon <br />the request of the Mayor, Council or any designated representative thereof, make the Facilities <br />available to the Village, without cost, for emergency use during the duration of the emergency or <br />disaster period. <br />Section 13. OTHER LEGAL REMEDIES. <br />13.1 Other Legal Remedies. <br />Nothing herein contained shall limit or restrict any legal rights that the Village may possess <br />arising from any alleged violation of this Permit, and the Village reserves all rights available to it <br />under current or future laws. <br />Section 14. NON-WAIVER. <br />14.1 Non-Waiver <br />The Permittee shall not be excused from complying with any provisions of this Permit by any <br />failure of the Village to insist upon or to seek compliance with such provisions. <br />Section I5. RIGHTS CONFERRED. <br />15.1 Rights of City and Permittee <br />Except as otherwise provided by Section 8, this Permit governs rights between the Village <br />and the Permittee, and is not intended in any way to confer any rights, duties or obligations upon any <br />third parties. The Permittee shall conduct the work to be performed pursuant to this Permit as an <br />independent contractor and not as an agent of the Village. <br />Section 16. VILLAGE'S RIGHT TO PURCHASE OR CONDEMN. <br />16.1 Village's Right to Purchase or Condemn <br />The right of the Village to construct, purchase, or condemn any public works or ways, and <br />the rights of the Permittee in connection therewith, as provided by the Ohio constitution and statutes <br />are hereby expressly reserved. <br />29 <br />
