M.V. ORDINANCE N0. 90-1 Page -2- The question to appear on the ballot shall be as follows: A. SHALL ORDINANCE N0. 89-42, AN ORDINANCE AMENDING SECTION 1181.03(c) OF THE CODIFIED ORDINANCES OF HAYFIELD VILLAGE, OHIO AND INCREASING THE LOT AREA PER FAMILY FOR A TWO-FAMILY DWELLING AND APARTMENT HOUSE IN A CLASS A-3 DISTRICT, BE ADOPTED? SECTION 2. The Clerk of Council is hereby authorized and directed to certify a copy of this Ordinance to the Cuyahoga County Board of Elections not less than sixty (60) days prior to the regularly scheduled Primary Election on May 8, 1990, in order to have the Ordinance and issue contained herein placed on the ballot for this said Primary Election and to take whatever other steps are necessary in order to comply with all directives of the said Board of Elections in order to secure placement on the ballot as aforesaid. SECTION 3. The Director of Law is hereby authorized and directed to confer with the Board of Elections of Cuyahoga County, Ohio and the Secretary of State for the State of Ohio, regarding the ballot question and to make any changes necessary to comply with current election law so long as the substance of any issue is not changed. In the event if the necessity of a substantial change of any issue, the Council shall first be consulted. SECTION 4. The Clerk of Council is hereby authorized and directed to either mail a copy of the full text to the proposed Ordinance at least thirty (30) days prior to the date of the election as set forth in this Ordinance to each elector of the Municipality whose name appears upon the registration books for the last regular election held in the Municipality or shall cause the full text of the proposed Ordinance to be published once a week for not less than two (2) consecutive weeks in a newspaper of general circulation in the Municipality with the first publication being at least fifteen (15) days prior to the election. SECTION 5. The Council finds and determines that all formal actions of this Council relating to the adoption of this Ordinance have been taken at open meetings of this Council; and that deliberations of this Council and of its committees, resulting in such formal action, took place in .meetings open to the public, in compliance with all statutory requirements including the requirements of Section 121.22 of the Ohio Revised Code. SECTION 6. This Ordinance is hereby declared to be an emergency measure immediately necessary for the preservation of the health, safety and welfare of the residents of Mayfield Village, Ohio, for the reason that the proposed Charter Amendment presented herein must be timely filed with the Board of Elections in accordance with current Ohio,Law in order to allow the electorate the opportunity to vote thereon.
