Amended 4/02/90 <br />II <br />ORDINANCE N0. 90-17 <br />INTRODUCED BY: Mayor Carmen and Council Members <br />AN ORDINANCE <br />GRANTING CONDITIONAL PARKING <br />VARIANCE OF SIXTEEN (16) SPACES <br />TO MUSCA INVESTMENT COMPANY FOR A <br />PERIOD OF TWO (2) YEARS <br />AND DECLARING AN EMERGENCY <br />WHEREAS, the Planning and Zoning Commission approved plans submitted for <br />property known as "Village Plaza" so that such occupancy would be consistent <br />with the permitted uses in a Local. Business District, subject to the limita- <br />tion of one hundred fifty-one (151) parking spaces; and <br />WHEREAS, such plans, as revised on November 12, 1987, included nine <br />thousand (9,000) square feet to be used as office and five thousand eight <br />hundred twenty-five (5,825) square feet to be used as retail sales; and <br />WHEREAS, the developer after making a good faith effort to lease such <br />space in accordance with the plans submitted on November 12, 1987, petitioned <br />Council to convert four thousand six. hundred fifty-five (4,655) square feet <br />for office use to retail use; and <br />WHEREAS, on March 20, 1989, Council granted a parking variance of thir- <br />ty-six (36) spaces in order for the developer to use the remaining space for <br />retail use; and <br />WHEREAS, since such time the. developer has not been able to find a tenant <br />for such retail use; and <br />WHEREAS, the developer has petitioned Council to use three thousand three <br />hundred fifteen (3,315) square feet for medical offices, because of his <br />inability to lease such space as retail use; and <br />WHEREAS, such use as medical offices would require a parking variance of <br />sixteen (16) spaces; and <br />WHEREAS, the developer has represented to the Council that there will not <br />be any office hours after 6:00 P.M. at such medical offices in order to <br />
