04/1~/90~ <br />*See amended copy (6/25/90) <br />ORDINANCE N0. 90-20 <br />INTRODUCED BY: Mayor Carmen and Council as a Whole <br />AN ORDINANCE <br />ENACTING NEW CHAPTER 903 OF <br />THE CODIFIED ORDINANCES OF HAYFIELD VILLAGE, OHIO <br />PERTAINING TO SIDEWALK MAINTENANCE. AND <br />DECLARING AN EMERGENCY <br />BE IT ORDAINED BY THE COUNCIL OF HAYFIELD VILLAGE, OHIO, THAT.: <br />SECTION 1. The existing Part 9, Street, Utilities and Public Services <br />Code, of the Codified Ordinances of Mayfield Village, Ohio, be and the same is <br />hereby amended by enacting Chapter 903, entitled "Sidewalk Maintenance," to <br />read as follows: <br />Chapter 903 <br />Sidewalk Maintenance <br />903.01 Sidewalk Maintenance Responsibility. <br />Public sidewalks serving all. classifications of property are the <br />responsibility of and shall be maintained by the abutting property owner, it <br />being deemed necessary by Mayfield Village to require the repair and mainte- <br />nance of sidewalks. <br />903.02 Inspection Procedure. <br />The Building Department of Mayfield Village shall attempt to <br />inspect all. sidewalks every two (2) years from the date of passage of this <br />Ordinance. <br />(a) The inspection shall include surface condition., i.e. spalled or <br />checked surface cracks or joint separation, a differential elevation <br />in sidewalk sections. A differential elevation of sidewalk sections <br />of one-half (1/2) inch or less shall be deemed satisfactory and not <br />require replacement or leveling. <br />(b) Property owners or their agents shall be informed, in writing, of <br />the repairs required to bring the sidewalks abutting the property <br />into compliance. <br />(c) Said repairs or replacement shall be made within forty-five (45) <br />days from the date of receipt of. notice received by the property <br />owner, unless extensions are granted by the Building. Department due <br />to inclement weather or other unforeseen circumstances. <br />
