ORDINANCE N0. 90-21 <br />Page -2- <br />1127.02 Requirements.. <br />No person. shall. cause. or allow earth-disturbing. activities on a <br />development area except in compliance with the standards <br />and criteria set out in the Stormwater Management and <br />Urban Sediment Pollution Abatement. Rules.. (hereinafter <br />referred to as "Rules") <br />1127.03 Plan Review. <br />The Village Engineer shall. review all. sediment <br />control plans and. indicate compliance or noncompliance to <br />the person who filed. the plan. Indication. of noncompli- <br />ance shall include the. plan deficiencies and the proce- <br />dures for filing a revised plan. Pending preparation. and <br />approval (determination of status of. compliance.) of a <br />revised plan, earth-disturbing activities shall proceed <br />only in accordance with conditions outlined on the ap- <br />proved plan.. <br />1127.04 Inspection to Ensure Compliance. <br />The Village or its representative may inspect development <br />areas to determining comgl.iance.with these regulations. <br />If it is determining that a violation of these regulations <br />exists, the responsible person will be notified of the <br />deficiencies or noncompliance. After a period of thirty <br />(30) days for voluntary compliance, the inspector shall <br />report the deficiency or noncompliance to the Village <br />Engineer. The Village upon determination that a person is <br />not complying with these regulations, may issue, by <br />certified mail., an order to comply. The order. shall <br />describe the problem. and the work needed and. specify a <br />date whereby the work must be completed.. <br />1127.05 Performance Bond. <br />Performan.c.e Guarantee <br />Concurrently with the application for approval, the owner must <br />execute and file with the Municipality a performance bond, secured. <br />as hereinafter required. <br />(A) Form of Bond.. The performance band shall. be conditioned upon <br />proper installation of all improvements required by the <br />Rules, according to the approved plans and specifications, within <br />six (6) months of the final approval.. The Municipality shall <br />have the right, in the event of default., to install the. required <br />
