CS-2 Rev.~6/1/87 <br />SECTION IV (Heintenence, Perking Traffic Control Signals end Devices) <br />That upon completion of said improvement, said Yillage, will thereafter keep eeid highway open to <br />traffic et ell times, end <br />(e) Meintein the improvement in accordance with the provisions of the statutes relating thereto <br />end make ample financial end other provisions for ouch mafntenence; end <br />(b) Meintein the right-of-++ey end keep it free of obstructions in a manner satisfactory to the <br />Stets of Ohio and hold eeid right-of-wey inviolate for public highway purposes end permit <br />no ^igne, posters, billboards, roadside stands or other private inetnlletionr within the <br />right-of-way Limits; end <br />(c) Piece end maintain ell traffic control devices conforming to the Ohio Manuel of Unifora <br />Traffic Control Uevicea on the improvement in compliance with the provieiona of Section <br />4511.11 and related sections of the Ohio Revised Code; and <br />(d) Regulate perking in the following manner: <br />Prohibit parking within the limits of the pro,~eot at all times. <br />SECTION V <br />(Right-of-Key, Utility Aeerrnngement and Demege end Liability Responsibilities) <br />(a) That all existing street end public way right-of~-way within the Village which is necessary <br />for the aforesaid improvement, shell be made eveileble therefor. <br />(b) Thet the State/Village will acquire any additional right-of-wey required for the construction <br />of the aforesaid improvement. <br />(c) Thet errengements have been or will be mode with and agreements obtained from ell public utility <br />companies whose lines or structures will be nffeeted by the Bald Lmprovesent end amid companies <br />have agreed to make any end ell necessary plant removals or reerrengemeots in such manner m <br />to be clear of any construction culled for by the plena of eeid improveaent end said compmiea <br />have agreed to make ouch necessary rearrengementa immediately after notification by said Village <br />or the Department of Tranaportetion. <br />(d) Thet it ie hereby agreed that the Yillage shall et its own expense, make all renrrnngementa of <br />water mains, service lines, fire hydrants, valve boxes, sanitary sewers or other municipally <br />owned utilities and/or any appurtenances thereto, which do not comply with the provisions of <br />Directive No. DH-P-411. <br />(e) Thet the conetrucl.ion, reconstruction, end/or reerrnngement of both publicly end privately owned <br />utilities, referred to in subsections (c) and (d) ebave, shell be done Ln such a manner a• not <br />to interfere unduly with Lhe•operetion of the contractor constructing the improvement and all <br />bnckfilling of trenches made neceseery by ouch utility reerreng~ente ^hell be performed in <br />eccordence with the provieiona of the Ohio Department of Treneportetion Construction end <br />Material Specifications and shall be subject to approval by the State. <br />(f) 7'hAt the inetelletion of ell utility facilities on the right-of-++ay shell conform with the <br />requirements of the Federal Highway Adeinietretion Policy end Procedure Memorandum 30-4 <br />"Utility Relocations end Adjustaents" end the Department of Treneportation'^ rules on <br />Utility Accommodation. <br />(g) Thnt the Village hereby agrees to accept responsibility for any and ell damages or claims fur <br />which !t is legally liable arising from the negligence of its officers, employees or egente <br />in the performance of the Village's obligations mode or agreed to in Sections (e), {b), (c), <br />(d), (e) end (f) liereinabove. Likewise, The State agrees to accept responsibility for any and <br />all damages or cloims for which it ie legally liable arising from the negligence of its officers, <br />employees or egente in the pee•formence of the Stete'e obligations made or agreed to in Sections (e), <br />(b), (c), (d), (e) and (f) hereinebove. <br />Page 2 of 3 <br />
