Builder hereby acknowledges, and balance due no later ~~ than three (3) days before parade. Float will not be released for use unless purchase price is paid in full in advance•as provided herein and all other terms of this Agreement are fulfilled. 3. In case of inclimate weather, customer agrees to the following: (a) If Builder is notified prior to commencing the trans- porting of the float to the parade. Customer is liable for the entire amount of all custom made floats and SO% of the amount of other units. Said fee is recognized by customer as-necessary to compensate Builder for materials and labor provided, and for Builder's failure to lease the unit to another party since Builder is bound hereby. {b). If Builder is not so notified prior to commencing transportation of the float to the parade, customer shall be liable for transportation costs as herein described, in addition to sums specified in 3 (a)-above. (c) If the parade is rescheduled for another date, and customer desires to use the float on the new date, then: (i) Custom floats will be delivered under fire same terms and conditions set forth in paragraphs 1, 2, 3, and 4 above, provided, however, customer shall pay Builder for transportation costs for the rescheduled date at least three (3)days prior to the rescheduled date. (ii} Other floats will be made .available tv customer on rescheduled dates only if said float was noC available at the time customer notified Builder of the rescheduled date, scheduled by Builder for another parade. In the event any unit is available on the rescheduled date,-customer, upon timely payment of transportation costs for the rescheduled date, may use said float at the price originally agreed to. -2-
