s/2o/90 <br />RESOLUTION N0. 90- 52 <br />INTRODUCED BY: Mayor Carmen and Council as a Whole <br />A RESOLUTION <br />GRANTING A SPECIAL U-6 USE PERMIT TO <br />HONDROS CAREER CENTERS TO USE CERTAIN <br />PREMISES FOR A CONTINUING EDUCATION CENTER <br />FOR A PERIOD OF FIVE (5) YEARS <br />AND DECLARING AN EMERGENCY <br />WHEREAS, Hondros Career Centers, has requested that certain premises <br />known as the Beta Office Complex located at 777 Beta Drive be used for a <br />continuing education center; and <br />WHEREAS, the said premises are located within a use district zoned for <br />office-production use; and <br />WHEREAS, the Mayor and Council acknowledge that, pursuant to the provi- <br />sions of Section 1149.02 of the Codified Ordinances of Mayfield Village, <br />entitled "Use District Exemptions," the Class U-6 use may be permitted in any <br />use district; and <br />WHEREAS, on August 16, 1990, the Planning and Zoning Commission recom- <br />mended to Council that a special permit be granted to Hondros Career Centers <br />to operate a continuing education center in compliance with certain condi- <br />tions; and <br />WHEREAS, it has been determined by Council that such use would substan- <br />tially serve the public convenience and welfare and will not substantially or <br />permanently injure the appropriate use of the neighboring properties; now, <br />therefore, <br />BE IT RESOLVED BY THE COUNCIL OF HAYFIELD VILLAGE, OHIO, THAT: <br />SECTION 1. Council finds that the use of the property located at 777 <br />Beta Drive as a continuing education center will substantially serve the <br />public convenience and welfare and will not substantially or permanently <br />injure the appropriate use of the neighboring property, and further that such <br />use will not be injurious, obnoxious or offensive by reason of omission of <br />refuse water, odor, dust, fumes, vibrations, smoke, gas, noise, or otherwise <br />and will not be dangerous or harmful to life, health, property or morals and <br />will not cause undue congestion on the public highways. <br />
