M.V. RESOLUTION N0. 90-52 Page -2- SECTION 2. Council hereby confirms the permit and approval recommended by the Planning and Zoning Commission of Mayfield Village on August 16, 1990 to Hondros Career Centers, to operate a continuing education center as a Special U-6 Use Permit upon the premises, subject to the conditions hereinaf- ter set forth. SECTION 3. The Special Use Permit granted herein is subject to the following terms and conditions: A. Such premises shall be inspected on an annual basis by the Building and Fire Inspectors. B. There will not be more than fifty (50) students attending classes on the premises during any one time. C. This Permit may be revoked for any period of time or revoked by the Planning and Zoning Commission upon ten (10) days written notice and hearing for any one or more of the following reasons: (1) Failure to comply with any laws or ordinances applicable to the business and. operation of the center; (2) Failure to pay any taxes due to Mayfield Village in connection with the business of the Permittee. (3) Operation of the business authorized. by this Permit in a manner determined. by the Planning and Zoning Commission to be detrimental to the health, safety, morals or welfare of the residents of Mayfield Village or in such a manner as to constitute a nui- sance, or permitting the grounds or buildings to become unsafe or unsightly; SECTION 4. The Permittee shall have no more than ninety (90) days to comply with any violation of the terms and conditions set forth hereinabove, said ninety (90) day period to commence after the Permittee receives written notice from the municipality of such violation. SECTION 5. The Special Use Permit granted herein shall be in force and effect. for a period of five (5) years beginning. September 1, 1990. SECTION 6. The Council finds and. determines that all formal actions of this Council relating to the. adoption of this Resolution have been taken at open meetings of this Council; and that deliberations of this Council and of its committees, resulting in such formal action, took place in meetings open to the public, in compliance with all. statutory requirements including the requirements of Section 121.22. of the Ohio Revised Code.
