1/21/91 <br />*FAILED 1/21/91 <br />RESOLUTION NO. 91-05 <br />INTRODUCED BY: Mayor Carmen and Council as a Whole <br />A RESOLUTION <br />FOR THE ACCEPTANCE OF AN EMERGENCY ORDINANCE <br />APPROVING THE REVISED DISTRICT DISPOSAL FEES <br />AND PLANNING ASSESSMENT SCHEDULE TO PAY THE <br />COST OF A SOLID WASTE MANAGEMENT PLAN FOR <br />FOR CUYAHOGA COUNTY, AS SET FORTH IN <br />RESOLUTION NO. 901211-A, PASSED DECEMBER 11, 1990, <br />BY THE CUYAHOGA COUNTY PLANNING COMMISSION, AS <br />NECESSITATED BY OHIO REVISED CODE 3734.57 <br />WHEREAS, the Ohio Solid Waste Disposal Act, effective June <br />24, 1988, mandates that all counties establish a Solid Waste <br />District and a Solid Waste Management Policy Committee to <br />prepare, adopt and submit to the Ohio Environmental Protection <br />Agency a Solid Waste Management Plan (Section 3734.52-56, Ohio <br />Revised Code); and <br />WHEREAS, through its Resolution No.814313, adopted August <br />29, 1988, the Cuyahoga County Board of Commissioners formed a <br />single-county Solid Waste Management District, in accordance with <br />Section 3734.152 of the Ohio Revised Code; and <br />WHEREAS, the Director of the Ohio Environmental Protection <br />Agency, on March 30, 1989, designated the Cuyahoga Planning <br />Commission to serve as the Solid Waste Management Policy <br />Committee for the Cuyahoga County Waste District purchase to <br />Section 3734.54(D) of the Ohio Revised Code; and <br />WHEREAS, the activities to be undertaken by the Cuyahoga <br />County Planning Commission in its capacity as the Solid Waste <br />Management Policy Committee for the Cuyahoga Solid Waste <br />District, relative to preparation, adoption and submission of the <br />Solid Waste Management Plan to the Ohio Environmental Protection <br />agency are consistent with its Bylaws and Powers and Duties <br />prescribed by the Ohio Revised Code, Section 713.22, et seq,; and <br />WHEREAS, The Ohio Solid Waste Disposal Act authorized the <br />Solid Waste Management Policy Committee to levy fees upon <br />disposal of solid wastes at solid waste disposal facilities <br />located within the district for the purpose of preparing, <br />revising and implementing a Solid Waste Management Plan, <br />including without limitation the development and implementation <br />of Solid Waste Recycling and Reduction Programs; providing <br />financial assistance to Boards of Health within the District in <br />which solid waste facilities are located for the enforcement of <br />
