RESOLUTION NO. 91-05 Page 2 Sections 3734.01 to 373413 of the Ohio Revised Code and Rules, Orders and Terms and Conditions of permits, Licenses, and Variances issued under those Sections, providing financial assistance to the County and Municipal Corporations and Townships to defray the added costs and maintaining roads and other public resulting from the location and operation of a solid waste facility within the County, Municipal Corporation, or Township under the District's approval Solid Waste Management Plan; and paying the costs incurred by Boards of Health for collecting and analyzing water samples from public or private wells on land adjacent to solid waste facilities that are contained in the approved or amended plan of the Solid Waste Management District (Section 3734.57, Ohio Revised Code); and WHEREAS, a subsequent amendment to the Ohio Solid Waste Disposal Act, effective April 18, 1990, authorizes the Solid Waste Management Policy Committee to levy a solid waste management planning assessment on Municipal Corporations and Townships within the district for the purposes of defraying the costs of preparing, adopting and submitting the initial Solid Waste Management Plan of the County (Section 4 of .am. H.B. 656, passed April 3, 1990; and WHEREAS, Resolution 901211-A, passed December 11, 1990, by the Cuyahoga County Planning Commission sets forth the combined structures of district disposal fees and planning assessments, as a reasonable basis for equitably distributing the costs of preparing, adopting and submitting the initial Solid Waste Management Plan among Municipal Corporations and Townships of the District; and WHEREAS, this Resolution constitutes an emergency measure providing for the usual daily operation of a Municipal department; now, therefore, BE IT RESOLVED BY THE COUNCIL OF HAYFIELD VILLAGE, OHIO, THAT: SECTION 1. In accordance with Section 3734.57(B) of the Ohio Revised Code, the revised District Disposal Fees and Planning Assessment Schedule set forth in Resolution 901211-A, passed December 11, 1990, by the Cuyahoga county Planning Commission, is hereby approved by this Council.
