RESOLUTION NO. 91-05 <br />Page 2 <br />Sections 3734.01 to 373413 of the Ohio Revised Code and Rules, <br />Orders and Terms and Conditions of permits, Licenses, and <br />Variances issued under those Sections, providing financial <br />assistance to the County and Municipal Corporations and Townships <br />to defray the added costs and maintaining roads and other public <br />resulting from the location and operation of a solid waste <br />facility within the County, Municipal Corporation, or Township <br />under the District's approval Solid Waste Management Plan; and <br />paying the costs incurred by Boards of Health for collecting and <br />analyzing water samples from public or private wells on land <br />adjacent to solid waste facilities that are contained in the <br />approved or amended plan of the Solid Waste Management District <br />(Section 3734.57, Ohio Revised Code); and <br />WHEREAS, a subsequent amendment to the Ohio Solid Waste <br />Disposal Act, effective April 18, 1990, authorizes the Solid <br />Waste Management Policy Committee to levy a solid waste <br />management planning assessment on Municipal Corporations and <br />Townships within the district for the purposes of defraying the <br />costs of preparing, adopting and submitting the initial Solid <br />Waste Management Plan of the County (Section 4 of .am. H.B. 656, <br />passed April 3, 1990; and <br />WHEREAS, Resolution 901211-A, passed December 11, 1990, by <br />the Cuyahoga County Planning Commission sets forth the combined <br />structures of district disposal fees and planning assessments, as <br />a reasonable basis for equitably distributing the costs of <br />preparing, adopting and submitting the initial Solid Waste <br />Management Plan among Municipal Corporations and Townships of the <br />District; and <br />WHEREAS, this Resolution constitutes an emergency measure <br />providing for the usual daily operation of a Municipal <br />department; now, therefore, <br />BE IT RESOLVED BY THE COUNCIL OF HAYFIELD VILLAGE, OHIO, THAT: <br />SECTION 1. In accordance with Section 3734.57(B) of the <br />Ohio Revised Code, the revised District Disposal Fees and <br />Planning Assessment Schedule set forth in Resolution 901211-A, <br />passed December 11, 1990, by the Cuyahoga county Planning <br />Commission, is hereby approved by this Council. <br />
