FROM HOUFINCSEK INC 2.17.1992 10:06 P. 7 M. The VILLAGE will na~.ify the COUNTY when any work is being done in the vicinity of the sanitary sewer that may affect the integrity oi' the sewer .' ~I. The VILLAGE hereby adopts the County Rules, Regulations and Uniform Standards for sewerage Improvements as adopted by the Board of Caunty Commissioners. O. The VILLAGE agrees to indemnify and save harmless the covNTY, its Board of Commissioners, its Sanitary Engineer, their employees, agents or assigns far any and all liab~,lity for loss, damage, ar injury to the VILLAGE or to any thud party arising out of or in any way ;connected with the COUNTY'S performance under this Agreement, whether it be caused by the negligence of the COUNTY, its Board of Commissioners, its Sanitary Engineer, and employees, agents or assigns or otherwise with the following exceptioa~s: 1. The acts or omissions of a County employee wexe manifestly outside the scope of his employment ax' official responsibilities. 2. The acts or omissions of a County employee were with malicious purpose, in bad faith or in a wanton or reckless manner. SECTION IYI - PUMPING STATIONS AND FARCE MAINS A. The GoUNTY shall own all pumping stations and force mains within the municipal l~,mits and obtain all required regulatory agency permits. H. Before construction and/or expansion of any pumping station or force main, the plans steal], be reviewed and approved by the Village Engineer and The COUNTY. C. The COUNTY agrees to provide the necessary personnel, equipment and material to operate and repair County-owned pumping station and force main facilities. D. The COUNTY shall make all necessary repairs or improvements to the pumping station and force main facilities. E. The C®UNTY shall be responsible for the cost o£ expansian of any pump station or force main facility. -4-
