equipment, trucks and all other items necessary to <br />provide refuse collection, removal including disposal <br />services of recycle material as specified and to <br />perform all of the work called for and described in the <br />Contract documents. As of the date of this Contract, <br />the Village has taken all appropriate action necessary <br />to lawfully grant such franchise to Contractor. <br />.~ <br />~~ <br />• <br />2. The Contract shall be for a period of two (2) years <br />beginning August 1, 1991, and ending July 31, 1993, for <br />a rate of Twelve Dollars and Forty-Four Cents ($12.44) <br />per home per month. <br />3. The Contract documents shall include the following <br />documents and this Contract does hereby expressly <br />incorporate same herein as fully as if set forth <br />verbatim in this Contract, a copy of which is attached <br />hereto and made a part hereof as 1°Exhibit A": <br />A. <br />B. <br />C. <br />D. <br />E. <br />F. <br />G. <br />The Request for Proposals; <br />The instructions to Proponents; <br />The Contractor's Proposal; <br />The General Specifications; <br />The Resolution of Mayfield <br />ordering or authorizing the <br />contemplated herein; <br />Village Council <br />work and services <br />The Performance Bond; <br />This Instrument; and <br />Ii. Any addenda or changes in the foregoing documents <br />agreed to by the parties hereto. <br />4. It is the controlling intention of both the Village and <br />Contractor that the Contractor shall at all times <br />occupy the status of an independent contractor and not <br />that of any employee, agent or legal representative of <br />the Village. <br />5. In the event that Contractor requests permission to <br />park Contractor-owned collection vehicles on Village <br />property and the Service Director/Building Commissioner <br />grant such permission, it is understood and agreed that <br />the Village assume no liability whatsoever for any <br />damage, vandalism or destruction, whether minor or <br />major, to said vehicles while parked on said property, <br />nor will any damage, vandalism or destruction of said <br />vehicles be considered2under this Contact. <br />
