equipment, trucks and all other items necessary to provide refuse collection, removal including disposal services of recycle material as specified and to perform all of the work called for and described in the Contract documents. As of the date of this Contract, the Village has taken all appropriate action necessary to lawfully grant such franchise to Contractor. .~ ~~ • 2. The Contract shall be for a period of two (2) years beginning August 1, 1991, and ending July 31, 1993, for a rate of Twelve Dollars and Forty-Four Cents ($12.44) per home per month. 3. The Contract documents shall include the following documents and this Contract does hereby expressly incorporate same herein as fully as if set forth verbatim in this Contract, a copy of which is attached hereto and made a part hereof as 1°Exhibit A": A. B. C. D. E. F. G. The Request for Proposals; The instructions to Proponents; The Contractor's Proposal; The General Specifications; The Resolution of Mayfield ordering or authorizing the contemplated herein; Village Council work and services The Performance Bond; This Instrument; and Ii. Any addenda or changes in the foregoing documents agreed to by the parties hereto. 4. It is the controlling intention of both the Village and Contractor that the Contractor shall at all times occupy the status of an independent contractor and not that of any employee, agent or legal representative of the Village. 5. In the event that Contractor requests permission to park Contractor-owned collection vehicles on Village property and the Service Director/Building Commissioner grant such permission, it is understood and agreed that the Village assume no liability whatsoever for any damage, vandalism or destruction, whether minor or major, to said vehicles while parked on said property, nor will any damage, vandalism or destruction of said vehicles be considered2under this Contact.
