CONTRACT THIS CONTRACT, made and entered into this ~~ day of November, 1991, by .and between Mayfield Village, a Municipal Corporation of Cuyahoga County, Ohio (hereinafter called the "Village") and•Progressive Landscaping Design (hereinafter called "Contractor".). W I T N E S S E T_ H: WHEREAS, the Contractor did on the 27th day of September, 1991, submit a proposal to provide snowplowing for the driveways of the elderly residents within the Village; and WHEREAS, the proposal of September 27, 1991, for a rate of One Hundred Dollars ,($100.00) per drive for the period beginning with the first snowfall of 1991 through the last snowfall in the Spring of 1992, was accepted by the Village. NOW, THEREFORE, in consideration of the following mutual agreements and covenants, it is understood and agreed by and between the parties hereto as follows: 1. The Contractor is hereby granted the franchise, license and privilege within the territorial jurisdiction of the Village and shall furnish all personnel, labor, equipment, trucks and all other items necessary, to provide snowplowing services for the elderly residents as designated by the Village. As of the date of this Contract, the Village has taken all appropriate action necessary to lawfully grant such franchise to Contractor. 2. The Contract shall be for a period beginning with the first snowfall of 1991 through the last snowfall in the Spring of 1992, for a rate of One Hundred Dollars ,($100.00) per drive for snowplowing- for the elderly residents on those days that there is an accumulation in excess of two (2) inches. The drives shall be cleaned twice daily in a twelve (12) hour period as needed. Two passes will be made to assure clean passage of drives. Driveways will be marked of those residents who participate in the program and also to identify the edge of the drives.
