ORDINANCE NO. 91-31 <br />Page 3 <br />523.05 SERVICE OF NOTICE. <br />The notice may be served by delivering it <br />personally to the owner or leaving it at the owner's <br />usual place of business or residence, or by posting it <br />in a conspicuous place on the real estate, building or <br />structure involved, or by mailing it to the owner, or <br />by publishing it once in a newspaper of general <br />circulation within the Village if it cannot be served <br />in any of the other ways above mentioned. <br />523.06 PENALTY. <br />Whoever violates or fails to comply with any of <br />the provisions of this Chapter shall be guilty of a <br />misdemeanor and fined not more than One Hundred Dollars <br />($100.00) for the first offense. Whoever shall be <br />convicted of a violation of this Chapter for a second <br />or subsequent offense within a period of two (2) years <br />from the date of the next prior conviction shall be <br />guilty of a misdemeanor of the fourth degree and shall <br />be fined not more than Two Hundred Fifty Dollars <br />($250.00) or imprisoned for not more than thirty days <br />(30) or both. Each day of violation shall constitute a <br />separate offense. <br />523.07 RELATIONSHIP TO OTHER LAWS. <br />The authority to abate nuisances granted hereby <br />and the procedure set forth herein shall be in <br />additional to and shall not limit the authority to <br />abate nuisances granted in other Ordinances of the <br />Village of Mayfield or the Laws.and Constitution of <br />Ohio. <br />SECTION 2. The Council finds and determines that all <br />formal actions of this Council relating to the adoption of this <br />Ordinance have been taken at open meetings of this Council; and <br />that deliberations of this Council and of its committees, <br />resulting in such formal action, took„place in meetings open to <br />the public, in compliance with all statutory requirements <br />including the requirements of Section 121.22 of the Ohio Revised <br />Code. <br />SECTION 3.
