ORDINANCE NO. 91-31 <br />Page 2 <br />nuisance, the Service/Building Director is authorized <br />and directed promptly to cause its abatement as <br />hereinafter provided. <br />523.03 ABATEMENT OF CERTAIN NUISANCES WITHOUT DECLARATION <br />OF VILLAGE COUNCIL: NOTICE TO OWNER OF REAL <br />ESTATE. <br />The Service/Building Director, upon finding that a <br />nuisance exists in matters involving sidewalks, weeds, <br />tall grass, landscaping, or abandoned unusable personal <br />property or other debris, may cause written notice to <br />be served on the owner of the real estate. The notice <br />shall set forth the following items: (1) the nature of <br />the nuisance; (2) the estimate of the cost of abating <br />the same if done by the Village; (3) a reasonable time <br />determined by the Service/Building Director within <br />which the owner shall abate the nuisance or pay the <br />estimated cost to the Village; and (4) the statement <br />that unless the nuisance is abated within the stated <br />time, it may be abated by the Village and the cost of <br />? abatement assessed on the real estate involved, and the <br />Village may prosecute the owner for failure to comply <br />with the notice. Such notice of abatement may be <br />issued by the Service/Building Director without <br />reporting same to Council. In case the Village abates <br />the nuisance and the cost is not paid within the time <br />fixed by the Service/Building Director, the <br />Service/Building Director shall report the fact to <br />Council which may assess the cost on the real estate <br />from which the nuisance originated. <br />523.04 ABATEMENT OF OTHER NUISANCE. <br />If the Service/Building Director finds the <br />existence of any nuisance other than those enumerated <br />in Section 523.03, such official shall report such <br />facts to Council which may thereupon declare such <br />condition, building or structure a nuisance. The <br />Council may specify, upon the advice of.the Service/ <br />Building Director, what reasonable repairs or <br />maintenance measures are necessary to abate such <br />nuisance. <br />. Upon such finding and declaration, the <br />Service/Building Director may proceed in the manner <br />provided in Section 523.03 of this Chapter for the <br />abatement of nuisances.
