d. Any and all building(s) shall have a maximum height of two (2) stories <br />above ground of rentable space, excluding architectural features including but not limited <br />to, gable or hip roofs, parapet walls, and dome or tower elements. <br />e. The Village agrees to approve an on-going conditional use permit on PPN <br />831-OS-015 for medical office use, which such approval shall not to be <br />unreasonably withheld. The medical office use shall complement and operate in <br />conjunction with the current zoning. Notwithstanding, unless separately <br />approved, such medical office use shall meet parking requirements for medical <br />office. <br />f. The Improvements and Development shall conform with the Settlement and as <br />it may be clarified or amended. <br />g. The Improvements and Development shall have compatible architectural <br />features and streetscape aesthetics of North Commons Boulevard, including but <br />not limited to landscaping, street lighting, and signage. <br />h. The Improvement and the Development shall have awalking/bicycle path <br />that connects to existing paths throughout the Village, specifically connecting to <br />North Commons Boulevard and Route 91-SOM Center Road, as appropriate. <br />i. The Village shall approve a storm water management area, enhanced <br />landscaping and paths to be placed on PPN: 831-OS-007. A detailed storm water <br />management plan for the East Commons Property with consideration of the <br />impact on adjacent properties must be developed and approved by the Village <br />Engineer prior to either clearing of the East Common Property of trees or a <br />building permit being issues for any portion of Phase 1. <br />j. Any and all clearing of trees and natural vegetation from the East <br />Gammons Property shall only be done, as deemed necessary, by and with the <br />approval of the Village Building Commissioner and Engineer, for the construction <br />of the Improvements and each phase of the Development including construction <br />of the storm water management areaand/or wetland mitigation efforts. In the <br />event that any part of the East Commons Property is cleared of trees and/or <br />natural vegetation and construction has not yet been approved or commenced for <br />that part of the East Commons Property, the construction of the landscaping <br />buffer requirements below may be accelerated and immediately imposed. <br />Notwithstanding, East Commons has obtained a permit from the Ohio EPA and <br />the Army Corps of Engineers, a copy of which is attached to this Agreement as <br />Exhibit "F" to fill all the wetlands ("Wetland Areas") on the East Commons <br />Property. Upon satisfying the Permit Contingency and the Rezoning Contingency, <br />East Commons will be permitted, at its sole discretion, to clear and fill the <br />Wetland Areas after providing the Village with fifteen (15) days notice of East <br />Commons' intent to do so. <br />4 <br />
