ORDINANCE NO. 2009-55 <br />INTRODUCED BY: Mayor Rinlcer and Council as a Whole <br />AN EMERGENCY ORDINANCE <br />CREATING SECTION 905.011 <br />OF THE VILLAGE'S CODIFIED OI2DINANCES <br />RELATING TO VEHICLE PERMITS, FEES AND BONDS <br />FOR HEAVY EQUIPMENT. <br />WHEREAS, at this time, it has been deemed in the best interest of the health, <br />safety and welfare of the Village to specifically create Codified Ordinance Section <br />905.011 to regulate heavy equipment on residential roadways in the Village by <br />requiring among other things a permit, payment of a fee, posting of a bond and proof of <br />insurance. <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF <br />MAYFIELD VILLAGE, OHIO, THAT: <br />SECTION 1. Section 905.011 of the Codified Ordinances of the Village is <br />hereby and herein created in the interest of preserving and protecting the residential <br />roadways in the Village that may be traversed by heavy equipment and shall read as <br />follows: <br />905.011 HEAVY EQUIPIVIENT AND VEHICLE PERIVIIT FEE; <br />BONI); INSURANCE. <br />No person shall make, cause, or allow vehicles and equipment <br />in excess of 80,000 pounds, that requires a special permit per Codified <br />Ordinance Chapter 339, to traverse upon anv paved or unpaved <br />portion of any municipal residential roadwav, whether dedicated or <br />undedicated, except upon the following terms and conditions: <br />(a) A permit shall be obtained pursuant to Codified <br />Ordinance Chapter 339; and
