ORDINANCE NO. 2009-68 <br />PAGE 2 <br />Labor Standards Act and are accorded to the employees covered by this subsection at <br />the sole discretion of the Municipality with the Municipality reserving the right to <br />rescind the overtime granted herein. Full-time department heads, the Police Chief and <br />the Fire Chief have the option of cashing out up to eighty (80) hours of comp time at <br />the end of each calendar year to be paid at the same time as the F.O.P. holiday time, <br />except for payments to be made during the vear 2010 where payment shall be <br />temporaril y suspended until such time as the Mayor and Council determine the <br />finances of the Village will allow such payments. <br />SECTION 3. Section 153.15(e) of the Codified Ordinances of the Village pertaining to <br />the payment for unused vacation time is hereby and herein amended to read as follows: <br />153.15 VACATION. <br />? <br />(e)Vacations shall not be cumulative, but must be taken within the year earned. Any <br />vacation not taken within the year earned shall be forfeited unless specific permission <br />to carry-over vacation time is obtained, in writing from the Mayor. However, full-time <br />employees may cash in any unused balance of vacation up to eight (8) hours at the end <br />of the year at the rate at which it was earned. Full-time firefighters may cash in unused <br />balances of vacation up to twenty-four (24) hours. Notwithstanding the above, <br />payments to be made in theyear 2010 shall be temporaril y suspended until such time <br />as the Mayor and Council determine the finances of the Village will allow such <br />payments. <br />SECTION 4. All other provisions of the Village's Codified Ordinances not <br />inconsistent herewith shall remain in full force and effect. <br />SECTION 5. The Council finds and determines that all formal actions of this Council <br />relating to the adoption of this Ordinance have been talcen at open meetings of this Council; <br />and that deliberations of this Council and of its committees, resulting in such formal action, <br />took place in meetings open to the public, in compliance with all statutory requirements <br />including the requirements of Section 121.22 of the Ohio Revised Code.
