Cablevision/Mayfield Village Franchise Agreement 2000 Page No. -17- borne exclusively by the Grantee are: (1) The cost of the fibers; (2) The cost of constructing the fiber to the facilities listed in Exhibit E; (3) The cost of fifty (50) feet of fiber only once it is inside the exterior wall of the facility listed in Exhibit E; (4) The cost of maintaining the I-Net to the point of entry into the facilities listed in Exhibit E. (b) The user of the I-Net, which may, be the Grantor, local school district, or library system shall be responsible for and bear the cost of: (1) Any additional indoor wiring beyond that provided in subparagraph (a). (2) Equipment to utilize the I-Net within their respective building(s). (3) Any interior conduit necessary to house the fiber; (4) The cost to maintain their equipment for their utilization of the I-Net. (c) There shall be no cost to the users of the I-Net within the Franchise Area. (d) Upon completion of the current system upgrade in Northeast Ohio, and upon request from any community with which Grantee has a current Franchise Agreement, Grantee shall interconnect, at Grantee's sole cost, the I-Net with the other compatible dedicated fiber I- Nct's which Grantee constructs on behalf of other municipalities in Northern.Ohio it serves for the noncommercial use of the video, audio and data. (Hereinafter "Regional I-Net"). Within tl.e Grantee's cable service area, all costs associated with the c.+onstruction of the interconnection (within and between the various Franchise areas) shall be the sole responsibility of the Grantee. There may be a cost charged to the user for the use of the Regional I-Net outside of the user's Franchise Area. (e) Grantee shall be under no obligation to provide such interconnection for the Regional I-Net to a competitor, however, Grantee shall bear the sole cost and expense of enforcing this provision `against any entity challenging this exclusion, including the costs of reasonable attorneys fees and agrees to indemnify and Bold Grantor harmless for any costs associated with this exclusion. Section 32. Public, Educational or Government Access Channels and Facilities; Provision of Cable to Public Facilities.
