RESOLUTION NO. 99 -05 <br />INTRODUCED By: Mayor Rinker and Council as a Whole <br />AN EMERGENCY RESOLUTION <br />EXTENDING THE SPECIAL U-6 USE PERMIT TO <br />MAN'S HAIR PREVIOUSLY <br />GRANTED TO USE CERTAIN PREMISES FOR A BUSINESS <br />FOR A PERIOD OF FIVE (5) YEARS <br />WHEREAS, Man's Hair has previously requested that certain premises located <br />at 6571 Wilson Mills be used for a hair cutting business and now wishes to extend that <br />use for another five (5) years; and <br />WHEREAS, the said premises are located within a use district zoned or special <br />office building use; and <br />WHEREAS, the Mayor and Council acknowledge that, pursuant to the provisions <br />of Section 1149.02 of the codified ordinances of Mayfield Village, entitled "Use District <br />Exemptions" the Class U-6 use may be permitted in any use district; and <br />WHEREAS, on May 6, 1991, the Planning and Zoning Commission <br />recommended to Council that a special permit granted to Man's Hair to operate a hair <br />cutting business in compliance with certain conditions and Council approved that <br />permit through Resolution 91-41; and <br />(qq-al ) <br />WHEREAS, Man's Hair has requested an extension of the special use permit for <br />another five (5) years; and <br />WHEREAS, it has been determined by Council that such extension would <br />substantially serve the public convenience and welfare. and will not substantially or <br />permanently injure the appropriate use of the neighboring properties. <br />NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF MAYFIELD <br />VILLAGE, OHIO, THAT: <br />SECTION 1. Council finds that the use of the property located at 6571 Wilson Mills <br />Road as a hair cutting business will substantially serve the public convenience and welfare <br />and will not substantially or permanently injure the appropriate use of the neighboring <br />property, and further that such use will not be injurious, obnoxious or offensive by reason <br />of omission of refuse water, odor, dust, fumes, vibrations, smoke gas, noise, or otherwise <br />and will not be dangerous or harmful to life, health, property or morals and will not cause <br />undue congestion on the public highways.
