J <br />ORDINANCE NO. 99- 23 <br />~~ INTRODUCED BY: Mayor Rinker and Council as a Whole <br />AN EMERGENCY ORDINANCE <br />AUTHORIZING THE ADMINISTRATION TO <br />ENTER INTO AN AGREEMENT WITH <br />GLADYS RIVERS AND JAMES LYMAN RIVERS <br />AS AND FOR THE PURCHASE OF <br />PERMANENT PARCEL NOS. 831-07-005, 831-07-006, AND 831-07-010, <br />OTHERWISE KNOWN AS 396 S.O.M CENTER ROAD AND <br />400 S.O.M CENTER ROAD IN THE VILLAGE OF MAYFIELD <br />WHEREAS, the Village of Mayfield is desirous of acquiring the following property <br />as and for use in the Village's development of the North Chagrin Commons; and <br />WHEREAS, a fair market value of $420,000.00 has been agreed upon between the <br />Administration and Gladys and James Lyman Rivers. <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF MAYFIELD <br />VILLAGE, OHIO, THAT: <br />SECTION 1. The Mayor, President of Council, and Director of Law are hereby and <br />herein, authorized and directed to enter into a Purchase Agreement and to acquire the <br />~~~ property known as Permanent Parcel Nos. 831-07-005, 831-07-006, and 831-07-010, and <br />- municipally known as 396 and 400 S.O.M. Center Road, in the Village of Mayfield, for an <br />amount not to exceed $420,000.00, and upon the terms and conditions set forth in Exhibit <br />"A" attached hereto and incorporated herein by reference. <br />SECTION 2. The Council finds and determines that all formal actions of this <br />Council relating to the adoption of this Ordinance have been taken at open meetings of <br />this Council; and that deliberations of this Council and of its committees, resulting in such <br />formal action, took place in meetings open to the public, in compliance with all statutory <br />requirements including the requirements of Section 121.22 of the Ohio Revised Code. <br />SECTION 3. This Ordinance is hereby declared to be an emergency measure <br />immediately necessary for the health, safety and welfare of the residents of Mayfield <br />Village, Ohio. It shall, therefore, take effect immediately upon the passage by the <br />affirmative vote of not less than five (5) members elected to Council and approval by the <br />Mayor or otherwise at the earliest time allowed by law. <br /> <br />
