J ORDINANCE NO. 99- 23 ~~ INTRODUCED BY: Mayor Rinker and Council as a Whole AN EMERGENCY ORDINANCE AUTHORIZING THE ADMINISTRATION TO ENTER INTO AN AGREEMENT WITH GLADYS RIVERS AND JAMES LYMAN RIVERS AS AND FOR THE PURCHASE OF PERMANENT PARCEL NOS. 831-07-005, 831-07-006, AND 831-07-010, OTHERWISE KNOWN AS 396 S.O.M CENTER ROAD AND 400 S.O.M CENTER ROAD IN THE VILLAGE OF MAYFIELD WHEREAS, the Village of Mayfield is desirous of acquiring the following property as and for use in the Village's development of the North Chagrin Commons; and WHEREAS, a fair market value of $420,000.00 has been agreed upon between the Administration and Gladys and James Lyman Rivers. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF MAYFIELD VILLAGE, OHIO, THAT: SECTION 1. The Mayor, President of Council, and Director of Law are hereby and herein, authorized and directed to enter into a Purchase Agreement and to acquire the ~~~ property known as Permanent Parcel Nos. 831-07-005, 831-07-006, and 831-07-010, and - municipally known as 396 and 400 S.O.M. Center Road, in the Village of Mayfield, for an amount not to exceed $420,000.00, and upon the terms and conditions set forth in Exhibit "A" attached hereto and incorporated herein by reference. SECTION 2. The Council finds and determines that all formal actions of this Council relating to the adoption of this Ordinance have been taken at open meetings of this Council; and that deliberations of this Council and of its committees, resulting in such formal action, took place in meetings open to the public, in compliance with all statutory requirements including the requirements of Section 121.22 of the Ohio Revised Code. SECTION 3. This Ordinance is hereby declared to be an emergency measure immediately necessary for the health, safety and welfare of the residents of Mayfield Village, Ohio. It shall, therefore, take effect immediately upon the passage by the affirmative vote of not less than five (5) members elected to Council and approval by the Mayor or otherwise at the earliest time allowed by law.
