guests, or invitees,. and if the casualty is an insured casualty, the premises will be <br />repaired by the Lessor within a reasonable time, provided that the time period for repair <br />will not commence until insurance proceeds are received by the Lessor. In case of a <br />partial loss or destruction, there will be an abatement of rent corresponding with the <br />time during which,' and to the extent to which, the leased premises are untenantable. <br />Notwithstanding the above, if the leased premises are damaged to the extent that <br />Lessor shall decide not to rebuild, the term of the Lease shall end and the rent shall be <br />prorated up to the time of the damage. <br />Section 13 <br />SECURITY DEPOSITS <br />Included within the rent section of this agreement, and in the total amount <br />payable in advance, Lessor acknowledges the receipt of the sum of Eight Hundred <br />Dollars ($800.00) as a security deposit for the faithful performance of the Lease, which <br />shall be returned to Lessees upon faithful performance of this Lease. Further, Lessor <br />also acknowledges receipt of the sum of Five Hundred_ Dollars ($500.00) as a pet <br />deposit for the faithful performance of this Lease, which shall be returned to Lessees, <br />so long as no damage has been caused to the premises by such pet. <br />Section 1.4 <br />SURRENDER OF POSSESSION AT TERMINATION OF LEASE <br />At the expiration of the Lease term, Lessees shall leave and surrender the <br />premises in as good of a state and condition as it was in at the time of the <br />commencement of the Lease, reasonable use and wear of.the premises and damages <br />by the elements excepted. <br />Section 15 <br />DEFAULT <br />In the event any action is instituted at law to enforce any covenant contained in <br />this Lease agreement or to recover possession of the premises for any default or <br />breach of this Lease by the Lessees, Lessees shall pay reasonable attorneys' fees as <br />may be determined by the Court. <br />Section 16 <br />BINDING EFFECT ON SUCCESSORS AND ASSIGNS <br />The covenants and conditions contained in this Lease shall apply to and bind the <br />heirs, executors, and legal representatives of the parties to this Lease, and all <br />covenants shall be construed as conditions. <br />
